I have received a letter today made out in my formal name that I legaly changed in 1997/98 at aged 16!
This letter relates to Capital one which i presume is a credit card purely because I have a capital one visa in my name and have done for years. The most recent statement was received for that last week with £2 something outstanding as i cleared it last month.
it says:
SO mandate is for 14 payments of £25 which i make out to be £350 not £545.10.
Anyway WWYD. File letter in bin as junk?? CCA them or send something else. Letter is dated 23rd May 2008 as well.

Principle sum: £545.10
You have been written to on numerous occasions however the above debt remains outstanding. To avoid further action, a monthly payment plan must be in place within 7 days.
Therefore as a gesture of goodwill, our client will accept the account be paid by monthly instatments providing the standing order mandate is completed signed and returned to mackenzie hall within the next 7 days.
On receipt or the mandate being returned mackenzie hall will not take any further action against you providing you do not default on payments.

Lowells normally date/send their letters so that they arrive after or just before their supposed deadlines. It's a deliberate ploy to panic you.
Is this conceivably a debt of yours? I can't see it can be if it is in a name you haven't used since you were 16!

Nope definatly not my debt Fermi.
My parents gave me a silly forename but called me by my middle name so when I was old enough I legally changed my middle name to my forename by deedpoll.
The only think I ever had in my birth name was a halifax child savings account with a squirrel money box.

Section 40 of the Administration of Justice Act
“S40 Punishment for unlawful harassment of debtors.- A person commits an offence if, with the object of coercing another person to pay money claimed from the other as a debt due under a contract he-
- harasses the other with demands for payment which, in respect of their frequency, or the manner or occasion of making any such demand, or of any threat or publicity by which any demand is accompanied, are calculated to subject him or members of his family or household to alarm, distress or humiliation;
- falsely represents, in relation to the money claimed, that criminal proceedings lie for failure to pay it;
- falsely represents himself to be authorised in some official capacity to claim or enforce payment; or
- utters a document falsely represented by him to have some official character, or purporting to have some official character which he know it has not.
- A person may be guilty of an offence by virtue of sub-section (1) (a) above if he concerts with others in the taking of such actions as is described in that paragraph, notwithstanding that his own course of conduct does not by itself amount to harassment.”
