Cca Question

I requested my cca from Marlin for a sainsbury credit card. I rec a copy of my application form with a small bit about cca and see overleaf (reading the forum this has issues in itself). so i looked at the other copy they sent me which was the banks checklist which they attach to the back of the application hence no terms or limits etc :rolleyes: !!. The application dates back to 2000 and this copy is clearly from their microfilm thingee where they just copy front and back.
Marlin also stated that they had requested the statements of account. This I rec today but only 2 years worth.

my questions are

I am presuming they need the back of the application if they want to try and enforce at court:confused:
also
how many years statements should they have sent to comply with the soa request(or is there not a minimum or maximum):confused:

    If it is a S.A.R. and you paid the Ten pound ,you should get six years . When claim back charges you are intitled to 6 years statements . I would write back stating you are not happy with the copy of the APPLICATION FORM they sent. Remind them a true signed copy of the AGREEMENT IS REQUIRED .
    If you only sent £1 they do not need to send monthly statements . One month was missing from what I was sent, until they find the missing month the account is on hold .

    do i send the sar request to Marlin or sainsbury.

    also this card was originally lost and re issued about 4-5 years ago under a new number (the one they sold to Marlin) am i entitled to both sets going back to six years as it was a continious account, if not does that make the original application void for this card..... and if so a new cca should have been done????

    Sorry for all the questions but out of all of my many creditors marlin is the one gunning for me!!!!

    so a DCA then.

    If that is the case then You need to pay £1 get a copy of the legal assignation for the debt and a true copy of the original credit agreement. If both cannot be presented in full, then they cannot enforce the debt.

    I will try and find a template letter for you and post this back should I have the relationship correct.
