holiday pay when a temp?

my partner works partime for the council as a dinner lady. She is covering for 2 months while someone is away and then will work as and when needed (cover sickiness and holidays).

What holiday pay is she entitled too? what is the formula per hour worked?

    She is entitled to four times her normal working week (pro-rata) over the one-year period - where no anniversary date is given it will be the anniversary of her employment start date.

    Rate is the same as her usual hourly wage and cannot be taken before being earned. Usual rules on notice periods apply.

    If she's an agency worker it's possible the pay will be in her hourly rate at around 8%, so if that's the case check to be sure, since holidays will be unpaid under those circumstances.

    From 1 October 2007, statutory holiday entitlement has increased to 4.8 weeks a year (= 24 days for someone working 5 days/week). If she is working directly for the local authority, her entitlement may well be more than this.

    Details of entitlement should be in her written particulars.

    Oops, show's how long it's been since I worked in recruitment :D

    Also worth mentioning that bank holidays are *normally* not included in the entitlment if sticking to the WTD rules
  • Its actually 4.8 times her normal working week and it would be pro rata payable as earned

    So for example if she was working a 15 hour week for two months it would be

    60 days divided by 365 x (4.8 x 15) = just under 12 hours holiday

    Thereafter it would depend on the hours and days she works.

    i will check to see if the holiday pay is in the hourly rate.

    at the minute shee works five days a aweek but after the summer holidays she may only do 2 days one week then four and then maybe one day so how do i work this out? is there an easy way? is it 8% of each hour worked?

    Holiday pay should not be rolled up into the hourly rate. It used to be common but it should not happen now.
  • It does happen, there are a few agencies who still administer it separately but they're rare.

    When it is included in the rate it must be detailed as a separate pay item. The 8% figure used to relate to the hourly rate itself.
