Temp for 22 weeks - can they do this?

Am I right in thinking that you can only do 12 weeks as a temp in one go without being laid off otherwise they have to make you permanent?

Started my job as a 2week temp 22 weeks ago and just wondered where I stand. No contract now or at the start

    No, you are not correct.

    Temporary and permanent workers do (in theory) have equal rights, but there is no limit to how long someone may remain temporary, and even permanent workers have few rights within the first year.

    I was a temp in the same job for 3.5 years.

    My mum's just made it to 15 months in her's.

    Not sure where you have heard the *12 week rule* but dmg is correct :D

    Are your wages paid by the organisation for whom you carry out your duties or are you working through an agency?

    If you are working via an agency, you should have received written particulars near the start of your assignment - and you usually get this beforehand. If you are working for the employer direct, then you should have received something within two months of starting.

    There is no requirement at 12 weeks to be offered a permanent contract. However it is proposed that agency workers should receive "equal treatment" after 12 weeks in the same post. This is not yet on the statute book and it does not include being converted to a permanent role.

    The 12 week rule is also often seen in temp-to-perm arrangements, where an employer will make a decision at the 12th week, and may arrange a discount on the fee from the recruitment agency.

    check your contract of employment.

    go and see your local CAB if you are unhappy.
