consumer advice - cancelling carpet order help!

I ordered some carpet on Sunday afternoon and when asked if they fitted on saturdays was told no, as they are too tied up with contract work and it will have to be monday - friday, so i booked it in for friday 13th. no money was paid up front, and all i received was a paper slip with the cost of carpet and fitting in biro.

I can`t get the time off work and went into carpet right monday who do fit saturdays, so bought some carpet there and then.

phoned up carpet shop today to cancel, they say I have already ordered it and I will be invoiced. they also said they do saturdays and can fit me in on the 21st! can this be right? cannot I cancel on grounds I was "missold" on the fitting day?

any help appreciated!

    Buying a carpet and then getting it fitted are in fact two separate things.

    The Sale of Goods Act applies to buying the actual carpet and it exempts products that are made to your specifications. As carpets are ordered at a width to fit your specific room size you can't cancel them once ordered if you change your mind. (A good carpet shop would warn you about this before going ahead.)

    The fitting of the carpets comes under a different act - The supply of goods and Services Act.

    You should take into account that the majority of large companies that supply carpets and fit them use subcontractors to do the actual fitting. Therefore it depends if they can find one of their subcontractors available at the time you want.

    Unfortunately you are going to have to pay up for the carpet.

    Next time check if you can cancel something before buying another item on impulse. I know the salesmen in carpet right are pushy as lots of their offers are one day only but you do really need to check things first.
    I'm not cynical I'm realistic :p

    Did you sign a contract? Plus if they misled you regards fitting then I would not be keen to see if they do turn up on a saturday.
