Threatening to take money via card on record, can they?

Hello
I owe a payment to Swinton of £96.32, I have received a letter today saying.....
As per the terms and conditions of your consumer credit agreement with us, we shall collect the outstanding balancefrom the debit card you used to pay Swinton group Ltd, the collection will be made within 7 days of this letter, If this card is not yours please make the cardholder aware.

Can they do this? or can I contact my bank to refuse payment?

    Can you contact them and ask them to come to an arrangement to spread the rest of it over an affordable time span?

    It doesn't sound good to me. Not sure whether they are allowed to do that or not but bumping in case someonelse knows.

    I think the only way i can stop them taking a payment is to cancel / report lost my debit card!

    They are "threatening" to take money you owe them from a card number you gave them at the same time as signing a contract with terms and conditions saying then can do exactly that? Cancelling the card will not solve the problem, they will chase you, you will have to pay in the end. You don't say that you can't afford this payment, should we assume this is the case? If so, perhaps you might contact them and ask for the payment to be spread over a longer period?

    Yes this is the case I cannot afford to make the payment at this time, I will contact them but my priority is to stop them taking a unauthorised payment...I am sure that if i contact them now the payment may still be taken, I just dont want to risk it going through!

    You need to talk to the bank but I suspect this is the case.

    Certainly we have other instances of DCAs collecting the full amount when the OP thought they had authorised a part payment.
