Can council tax and rent arrears go on a bankruptcy form?
I desperatley need to take time off work but if I dont work I dont get paid so a catch 22 situation.
Usually current year CT no, but thats debateable, maybe, rent yes im sure
Whilst going through my papers this morning I found I should have gone to court re my Council Tax last WEDNESDAY so I now probably have a liability order and bailiffs pending it seems to be getting worse.
BR will halt al that, if the case was only last week youve maybe 3 weeks to sort it
I have CSA deductions from my part time job they are taken at source I earn £89.50 clear but end up with just over £50 because of the deductions, I have Working Tax Credits that keep me afloat.
The local council dont take CSA deductions into account when assessing Housing and C Tax Benefit so I have nothing left after paying rent ctax electric and gas.
I so want to tell my awful employer to stuff his job and walk out but if I do that I will have made myself intentionally unemployed, my friend said to go sick and claim Incapacity Benefit because of my mental health or Jobseekers, these places frighten me.
Again, ask your helper, if you havent one please contact your doctor, and get help
I feel like im invisible, (who said that? hello?) the only person thats listened to me was the lovley lady at the court yesterday when I went to hand in my defence forms, the lady from the council has been kind too explaining they have to go for posession but it will be on hold as long as I pay my rent but Im going to say my peice to the judge tommorow Im sick and tired of being ignored. I work and claim whats ok to claim but Im worse off working, each day is a struggle.

I need some advice re bankruptcy, and what debts can go on it, and how the heck do you get together money to pay for it, I honestly dont have a spare penny after paying basic living expenses and I mean basic no luxouries, even eating decently is a luxury some weeks.
Usually ALL debts (current year CT is a bit "grey")
I know deep down I will cope, I just want a debt free existance, with no hassle from folk, and to be able to not feel scared when the post box rattles and hoping my gas and electric meters dont run out.

I know this sounds dreary and self pitying but I feel bad today, is bankruptc that easy to achieve? I used to have a sense of humour and a bright outlook all I see at the moment is a sea of debt letters and snappy at the heel debt collection agencies who seem oblivious that I dont have money to paythem.
BR isnt hard or I couldnt have done it
Any advice would be most helpful thanks

Your biggest problem seems to be BR fees, 1. stop paying any debts, 2. you will get a reduction if on benefits (costs 395)0 -

Sorry I can't offer any advice re the bankruptcy etc. I only just found this site myself yesterday by accident, but I wanted to send you some ((hugs)) and best wishes.
I also suffer from some mental health problems so I can understand where you are coming from, it can make you feel very lonely, but the people who have answered me so far on here have all been lovely and very helpful.
I don't know if your seeing anyone but if not please see your GP in first instance and insist he put you forward for some counselling and not just fob you off with tablets which they do. I admit i'v mixed feelings re counsellors, some are good some bad, but I have found it helpful to have someone to talk too even if I think their advice or oppions have been of no value, I just use them as a sounding board and talking aloud about things in a safe atmosphere can sometimes help you make your own choices a bit clearer.
I have also found CAB to be very helpful, glad you got an appointment with them. I have trouble filling in forms and CAB have been great with various ones i'v had to do recently. Today I was also told the MIND charity are very helpful with debt problems if you have mental health issues as well, so i'v rung them up and I'm going to see them, there is a chance they can supply someone to go to court with you, this is what i'm hoping for.

I can't offer you any advice about the bankruptcy itself because I'm in Scotland and the law is different here, but after I read your post I wanted to leave a message to say that you aren't invisible or stupid, no matter how horrible you may be feeling right now.
You aren't stupid because you're in the process of taking a HUGE step right now by dealing with your debts. However you choose to do that, you are doing something, and that's very brave of you. Take it from someone who stuck their head in the sand (or up their backside) for ages, desperately trying to struggle through each month, before taking decisive action - it IS hard to do what you're doing now and you should remember that the next time you start thinking that you're stupid.
You aren't invisible either. All of us here are in the same position, or have been at one time. I've only posted on this board a couple of times, but I've spend hours reading everyone else's messages and I've learned loads here. One thing that blew me away was how quickly and helpfully people respond to each other. None of us are invisible.
About the mental health problems - have you been to your doctor? I was trying my best to cope without medication for the last couple of years and had avoided going to the doctor, but after pretty much having a breakdown recently, I trailed myself in to the docs to see if they could help. I could not believe how incredibly kind and helpful the doctor was when I said I was going through bankruptcy (I almost didn't mention it). I wish I knew how not to have panic attacks and how to just deal like a 'normal' person (whatever that is), but actually getting medical help is making a world of difference. Maybe you're more sensible than me and have already been doing the whole doctor thing, but if stuff has gotten way more stressful recently and you emotions/mood/mental state has changed, it may be worth talking to your doc again.0 -
Hi Anne- Have you tried Bankruptcyhelp.org.uk ? its a fantastic site and the administrators will provide you with all the help/advice you need.Echoing the wise words of others here i would reccomend the CCCS -they helped me loads- and yes they will provide you with a list of trust funds available,who may help pay for your court fees.
As for bankruptcy itself- i declared myself insolvent on the 20th of may and today had a meeting with the offical reciever.I know its all scarey stuff but just be honest and i can assure you its nowhere as hard as you naturally think.I owed over 20000 to loans,credit and store cards and which is now all writen off .I was told today that as i have no assets/ a rather low income and 3 dependents i will not be expected to contribute anything to my creditors and can be expected to be released from my bankruptcy in as little as 4 months time.
I, as many others here ,do know where you are at ,but please don't give up you will get through this.Good luck luck and try that website i mentioned they will help you0 -
