CCJ threat and letters from Court "HELP!!"

  • Ive just thanked you all for your participation in the thread "Thankyou" for your advice.

I have just emailed both Amber / GPB to request the information I spent so much time on the telephone on Friday requesting, I have also lodged an official complaint with Amber via their complaints proceedure before I take it to the FOS and FLA ;)

I have just sat down to work out my outgoings for next month and budgeted accordingly for the £345 that I will be paying to GPB to have the Judgement removed, this way at least I am showing willingness if I end up taking it further through the court etc... the only problem I am going to have is I dont actually get paid until the 25th July (exactly a month from the issue of the judgement). I will have to post-date the cheque and hope that because it has been issued within the month, this will satisfy the courts (or should I postdate it to the 24th or 23rd and hope it doesnt clear until the 25th) Is it also worth me sending a copy to the Court and also Amber? Is there a template letter I could send so it sounds all "official"?

I will also be visiting my local CAB tomorrow to see if they can offer any immeadiate advice.

Once again "Thankyou" for all of your imput and fingers x'd it will all come out smelling of roses

P.S. Is it worth me requesting a refund of the charges when I complain to the FOS / FLA (they would not of occured if my initial request had been carried out in Sept 2005) or am I pushing my luck ;)
  • Claim – XXXXXX
    Ref – XXX/XXXX

    Dear Sir/Madam

Following on from the recent Judgment that was issued to myself via Stafford Court, Claim – XXXXXX on the 25th June 2008.

Please find enclosed a cheque for the amount of £345GBP to clear the outstanding arrears on the account.

Please note that the judgment issued was for the amount of £625, since my partial admission in my defence, filed on the 13th March 2008 which the judgment was issued upon, I have paid £280, this includes £30 paid directly to yourselves on the 25th April 2008 and also a payment of £250 which was accepted by Amber Select on the 11th June 2008 (please refer to the enclosed letter from Amber), this leaves an outstanding amount of £345.

I would appreciate it if on receipt of payment you could forward me a receipt along with a covering letter to acknowledge that payment has been made so that I can make arrangements to have the Judgment removed from my Credit File.

Please also be aware that I will be making a formal complaint to both the FOS and FLA in regards to the way in which the account has been handled.

    Yours Sincerely,

    Mr. SilverdaleStokie

Just wrote the letter above and hopefully will be able to get my hands on the monies before the month is out....

    Would this suffice?
  • Well I got my "Satified" letter from GPB and will be forwarding this to the court to get the Judgement removed!

I WILL also be making complaints in regards to the way in which the companies dealt with the matter in the first place. Understandably, it was my debt and I owed the money BUT they did not send me the information when I initially requested it, which in turn would have saved on un-neccessary costs being added to the account.

Thanks again for all of your help and advice!
