CCJ advice needed please

My case worker at Citizens Advice is doing my financial statement to send to my creditors along with offers of payment. 1st Credit want £134.00 minimum on a £11,000 loan (these are so horrible !!!) but I think they will be offered about 115-120 per month. We are going away on Monday 9th June for 2 weeks (booked last year before money troubles), and am absolutely terrified that when we get back their will be a court letter on the mat waiting for us if they don't agree to the amount that is offered.

I have sent them a token payment yesterday as advised by our case worker but I just can't seem to get a grip. One minute i'm ok then the next i'm in tears....

Can anyone PLEASE tell me what the process is for a CCJ. Do they have to send a Default notice first.

PLEASE HELP ......

    Hi Crysta,
    They have to send out a default notice first before any legal actioncan take place. I think that with the difference between what 1st Credit want and what you'll be offering is so close that after some huffing and puffing they'll accept, particularly if you're on a debt management plan with the CAB. If they do take legal action then it will more than likely be a few more months down the line yet. A CCJ is not necessarily something to be afraid of.

    Firstly go and enjoy your holiday. There may be a few snottygrams from some creditors when you get back, but these will all have probably been computer generated automatically so they can be safely ignored. If CAB are negotiating on your behalf then your case worker is the one to seek out to see if there have been any developments.

    You should understand that most creditors don't take court action on most debts.

    I work for CAB on an LSC contract (Legal Help cases only) so am almost never able to make the sort of offer to First Credit that you are making. I can't remember ever seeing a court claim from them.

    Even if they did, they know you'd make an offer to pay 115-120 per month, asssisted by the CAB, and it might well be accepted by the court. So why should they waste their money on starting a claim ?
