TalkTalk Debt

Im sorry if I am posting this in the wrong section, please feel free to move it to the correct section.

I was wondering if anyone could give me some advice,
Around November last year I started receiving TalkTalk phone bills to my address but not in my name nor anyone who lives at my address, I though nothing of it the first month and just threw the bill away thinking it must have been a misake, as many MSE members will know I am a Virgin Media customer, not a BT one and have never used any servies like TalkTalk, AOL, etc, however the next month I received a bill saying "OVERDUE REMINDER" for the sum of £700 from TalkTalk, saying that failing to make payment will result in disconnection in the next 7 days, I though "go ahead, I dont have the service make my day" 7 days came and passed, my Virgin service still active, I knew I never had it on my line, it wasnt even my number on the bill!!!:mad:
However, 2 weeks passed and I received a letter from Carephone Warehouses debt collection department advising me of there intention to pass the debt for collection in 14 days, I rang them, now very pi**ed off!
I explained to them the person named on the bill wasnt and never has ben at my address nor did I know anyone by that name, that the number of the bill was not mine and that I had no BT line, and that the postcode on the bill was incorrect, finally I thought as he said, "Oh Im sorry about that, i will cancel the debt can I just have you name and postcode and telephone number, i happliy gave my name and the correct postcode but refused to give my telephone number stating I am ex-d, he said okay and said to just retunr any letters I may received dated up until the phone call.
However a week passed at the start of the year and I received a debt collection enforcement notice addressed to me in my name!!!!:mad: :mad:
For a debt of now £987 and with there legal fees and charges it brought the debt to £1052, the debt was in my bloody name and correct postcode, so the guy I had spoke to screwed me!!!!!!:mad: :mad: :mad:
He had changed the debt to my name and postcode knowing that I WAS living at the address, what a cheeky ******, anyway this debt states that if payment is not made within 14 days they will apply for a CCJ!!!
I am not contacting them because now I have no proof of ever contacting CPW as it was done over the phone, I am not paying a £1000 bill that some other :mad: has run up, I dont even have BT, But I received a letter, in this other person name to my address saying "We have been told by TalkTalk that they have cancelled your agreement, therefore any calls now made will be billed through us unless you inform us otherwise! !!!!!!???!!!
Any idela on how to sort this, prove that this debt doesnt even belong to me and I dont have a BT line!

    Just bumping this up, I would be seeing a solicitor and asking for stern letters to be sent. Did you send the letters back as requested?

    Hi Night Owl,

    What a terrible situation you are in! It's bad enough being chased for a bill/debt you have run up nevermind one that you haven't!

    I think the first thing you should have done back in November is either wrote on the envelope "not known at this address" or if you opened the letter in error you should have called them then and there and explained the bill was not for you and returned it to them immediately.

    Hopefully if anyone else receives any such letters in the future they will learn from your mistakes.

    I don't know what to suggest other than to ask BT for any necessary paperwork that was generated in setting up the account in the first place. Also I don't understand the connection between Carphone Warehouse and BT TalkTalk. I'm confused there so can't offer any comments.

    I do hope you sort it out and hope there is someone else who can offer better advice than me.

    As regards a CCJ they CPW have no grounds to apply, as the telephone number the bill is linked to is not owned by me.
    However I would say this will no doubt be reported to a CRA I know its not on my Experian at prsent, but whos to say it wont appear.

    If I was you I would write to BT Openreach and ask what the state of the phone line is to your address.

    Yes I know you don't have one, but a letter from BT stating you have no line could come in handy later.

    this may sound daft... but have u tried calling the number on the bill to see if they know anything about it? (sorry im not much help with legal stuff but its what id do)

    Well firstly I would send whoever is sending letters to you specifically the following.

    I found this on the national debt line website.

    Dear Sir/Madam
    Account No: 4563210025897412
    You have contacted us regarding the account with the above reference number, which you claim is owed by
    ourselves.
    We would point out that we have no knowledge of any such debt being owed to The Loan Company.
    We are familiar with the .Office of Fair Trading Debt Collection Guidance. which states that it is unfair to send
    demands for payment to an individual when it is uncertain that they are the debtor in question.
    We would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for
    payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried
    or disputed debt you are using deceptive/and or unfair methods.
    Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing
    to make unjustified demands for payment amounts to physical/psychological harassment.
    We would ask that no further contact be made concerning the above accounts unless you can provide evidence
    as to our liability for the debt in question.
    We await your written confirmation that this matter is now closed. Otherwise we will have no option but to
    make a complaint to the trading standards department and consider informing the OFT of your actions.
    We look forward to your reply.
