My Next account has been passed to these people. balance £400. had previously arranged with Next to pay £50 a month. did ok for last 5 months apart from last month (due 14th may) i missed it as i had no spare cash at all. was going to make payment today (salary has gone in) but ironically enough a letter just arrived from MOORCROFT. Now looking up these people on this site i am crapping as they seem to be really scary. It says to ring them to avoid court, baliffs etc but so far every time i go towards phone i back out as I really frightened they are going to make me pay the whole £400 today. As I have said my salary has gone in (only £715.00) and out of that I pay mortgage, and council tax. I be lucky to have £30 left over!!! What my OH brings in is already accounted for this month. What can they do? I dont want a ccj or anything. What if they refuse my offer? or do they have to make me pay whole amount? Lately if its not one thing its another, and im at the end of my rope

im new to all this but this i have learned - first of all take the threat of court and baliffs with a pinch of salt - as you have said you only missed one payment from an agreed plan so this is just scare tactics - another thing is did Next tell you they were passing the debt on - if not either call or write to these people and tell then that before you pay them anything you want confirmation in writing from Next that the debt has been transferred - you could also ask them to provide the CCA for this account and that could buy you time

No nothing from Next about Moorcroft!! Should I ring Next to ask them if its been transferred? When i agreed to a payment plan with Next I had all good intentions to pay the £50 a month but with hindsight I think £50 was heck of a lot promise. Had account with Next since my son was a baby and he is 15 now and never even went over halfway of the credit limit (limit was £1500, balance was usually £650) and I feel angry that i have spent hundreds over the years and when I am going through a difficult time they use these scary tactics. Appreciate i defaulted on a payment plan but they are quick to pass over to a dca within two weeks arent they? I am going to have a cup of tea before ringing these, and if they are very aggressive like some people say they are i am hanging up and putting everything into writing, dont want to spend the day in tears which is all I have been doing lately, especially this half term week with two boys off school and no money to take them even for a McDonalds! although they havent moaned bless them, even the youngest who has Aspergers and is usually quite demanding when he wants something, thank you Louie, this site is a godsend even if for support. x xDFW NERD....560

Personally i wouldn't phone Moorcroft keep your communication in written format, I have a debt with Moorcroft and they do have a tendency to be a bit harsh on the phone and try to bully you into payment more than you can afford.
What the above poster is saying about the CCA is right though but I am not up on my knowledge of this all yet but someone will be along to advise you on that soon and they normally help with the letters too.You never know how strong you are until being strong is the only choice you have.

Hi there, i have had dealings with MOORCROFT. Do not phone them. You have not been informed of NEXT trand=sferring the debt to them. The first thing you need to do is send a recorded delivery letter to MOORCROFT stating you do not acknowlegde any debt to them, i'll post up a link to the letter shortly. In this letter enclosed a cheque or postal order for 1.00 and request the following. A copy of the signed original credit agreement, a deed of assignment ( a letter from next passing over the debt and giving moorcroft permission to pursue this account) and a statement of account showing charges and payments made to the account. This will bide you time. In the meantime dont make any payments as this account is now in dispute.

Had a letter approx 5 months ago saying if I didnt keep up my monthly payments my account would be passed to a DCA, but then I rang them and came up with this repayment plan of £50 a month, the letter did not mention MOORCROFT then though, like I said I have paid on the 14th of every month apart from Mays and was going to try and pay something today. I have tried to log in to my account at Next online but my details have now not been recognised, dont know whether to ring Next and ask them if they had transferred account and if they sayyes then to put it in writing and send me it, although perhaps a letter is already on its way and MOORCROFT have been too quick in sending theirs!! Really hesitiant in ringing DCA though as Im not very good talking to people like these as I tend to egt upset which i am really angry with myself afterwards!! Confidence gets really dented when you feel like you have to begDFW NERD....560

We understand a copy of our credit agreement should be supplied within 12 working days.
We understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

just a couple of pointers...DONT SIGN this letter. DCA's have been known to aquire blank credit aggreements and copy the customers signture from letters. also i put in my cheque or postal order refernce on the letter, just so they know you seem to be 'on the ball'0 -

i've gotta say its very rare for companies to send out a deed of assignment to the client prior to you requesting one. You say you've had the account for 15 years or so, it would be interesting to see if next still have the agreement, if they dont then the debt is un-enforcable and you wont have to pay anyway!! Dont ring them, they will bully you, they dont listen and then they'll have your number and propbably harrass you.

yes you can send it recorded to these, this is where i sent my letters and they got delivered and signed for0
