default notice

Please can anyone tell me what happens when you have been sent a default notice . I have been sent one from the Bank of Scotland this morning , it looks very official .They are asking for the arrears which i have not got ,i have sent them a small payment and my income/expenditure so they can see what i can afford but they have not replied to that . please help thanks

    I means they can now make efforts to recover the debt . It usually results in them sending out threatening letters. They will probabaly pass it on to a collection agency . If you have not got the money do not miss the important things like rent and rate gas / electric etc . Keep making token payments , you could ask for them to freese the interest . If you get letters from DCA , despite what they say NEVER CALL THEM , NEVER GIVE THEM YOUR PHONE NUMBER ! Only contact them by letter . You my find it helpful to look at some of the other posts about DCA,S

    Ring them. Be stroppy with them and tell them that you have sent in an income and expenditure form and tell them what you can afford to pay it - AND PAY IT. Whether they like it or not. it proves you have made every attempt to pay them.

    Is it definitely a default or is it - we will default you if - disguised as a default notice.

    Do it now.. Please don't be worried. I always worried before I rang them and they were usually quite kind when I did. If they weren't I just told them I can't give you what I haven't got and rang back till I got someone more sympathetic

  • it says it is a default notice but if i pay the arrears in 7 days this will be lifted . I have also asked them to freeze interest etc they have ignored every letter i have sent i know they have recieved them as cheques have been cashed i have sent with the letters

    the significance of a default notice is that they are required to give you wriiten notice before defaulting your a/c with the credit reference agencies.

    If they get stroppy with you do a CCA REQUEST , If they do not produce it stop paying !

    good advise as i think if you do this it will put the debt into dispute and i dont think they can default you if its in dispute

    ive read here that some creditors refuse your reduced payments for 3 months or so then register a default then immediately sell the debt onto a DCA - i suspect this is what they are trying to do with you
