quandry about reclaiming credit card charges

Afternoon

Any thoughts?

I started the process of reclaiming crredit card charges using MSE templates before i went BR in Jan.I then forgot all about this until yesterday when i got a letter from capital one offering me partial settlement. Now Im sure even if i did reclaim this amount (its £400) the OR wodul want it and thats fine, but im hopeful of being getting early dischage in near future.

if I was discharged when I cccepted their offer could I legimatley keep the refund of my charged from capital one?

    I think - but I am not sure that if this becomes available to you whilst undischarged the OR would wish to have it even if accepted after discharge but it is possible I am wrong. I am just going by previous post I have read and my VERY BASIC knowledge. So I guess thats not very helpful- sorry

    No. You cannot keep it. When you are BR, you sign over EVERYTHING, debts and anything beneficial that may come from them.

    But - did you clear this particular credit card before BR? If so, then it was not a debt and not included in your BR and you can keep the money. If, however, you included it as a debt in your BR, then its not yours - its the OR's. Sorry.

    Debt was inc in BR so its not mine, do I have a duty to claim it back though if offered, or best to just ignore letter?

    might take advantage of being undischarged and send it to the OR to deal with

    Mmmmm. Call the OR and ask what they suggest. Giving them money would certainly go a long way to showing your honesty and that your not hiding anything (my personal philosophy is to own up to everything - then when you lie about the big stuff, people believe you.......)

    The OR may even tell you that he/she is not interested in it, but don't hold out too much!
