Hi all, I could really do with some help!
I have had a CCJ for about a year now, which I pay £5 per month, and I have received this letter from the Howard Cohen Solicitors this morning.
We refer to the Judgement Order in this matter which we have scheduled for review. You are currently required to pay £5 every month. This arrangement has been in place for some time. It is desirable that the instalment amount be increased, as we are sure you willa gree, it is in everyone's interest that this judgement Debt be satsfied as quickly as possible.
Please provide by return, details and evidence of your surrent income and expenditure, together with your proposed increased offer. An Evidence Of Mean Declaration is attached for your assistance. If we can agree an increased instalment then it will not be necessary for us to apply to the Courts for a formal amendment of the Judgement Order.
Now for my question lol .. oh the outstanding amount is £578.26
Are they aloud to do that?? surely cos the CCJ has been through and the judge has done it, I dont need to increase the payment?
Please someone help me, Im gettin a bit worried as I cannot afford to increase as I have my other debts Im paying too!
Any advice is gratefully recieved!

Hi.
I'm not sure of the answer, but logic says that they would have to apply to the courts to increase payments.
I'm sure someone will come along soon who is much more knowledgable than me (Its not hard)

Yes they have to apply to the court for the payment to be increased in exactly the same way that the debtor has to apply for a reduced payment.. In fairness, circumstances do change and it might be better for the OP to give the details rather than waste everyone's time going back to court.

basically if your situation is unchanged you should tell them so and then you should continue to pay the £5.If your finances have improved then it's up to you whether you tell them but as has already been said they could go back to court to find out.0

This may not apply, but you should be aware that if you have multiple debts, one or more CCJs and total indebtedness under £5000 you can get an Administration Order. I have managed to get quite a few of these (with composition) for clients at £10 per month with 90% of the debt written off after 3 years.
Not many people qualify these days so they tend to get forgotten, and the rules are changing next year. Just thought it was worth a mention.0
