Cooling Off Peroid for Credit Agrement
Hi,
I have just been reading the Citizens Advice Bureau site and wanted to see if my thinking was correct on something, any help will be very much appreciated....
My girlfriend has signed a credit agreement (for a gym membership) that states 'You have no right to cancel this agreement under the Consumer Credit Act 1974'. The membership is pretty expensive and now she is having second thoughts so I was wondering if they would be a way to cancel it.
She signed the agreement at the gym. However on the credit agreement it states that the agreement is between her and a creditor with a different address to that of the gym (and in fact a different company).
Now it states on the Citizens Advice Bureau site that you can cancel an agreement in a cooling off period if:
I was wondering if she had any right to cancel under a cooling off period as the agreement was actual signed away from the premises of the creditor (being at a different address to the gym)? Or because the agreement relates to membership at the gym and the agreement was signed there it means there will be no right to cancel under a cooling off period?
I hope that makes sense!
ps Fairly embarrassing that I can't spell!! Sorry for the incorrect spelling on the title!!

You can cancel the agreement if:-
- you signed it anywhere other than on the premises of the trader or creditor; and
- you discussed the credit face-to-face with the trader or creditor before you signed the agreement.
