OR: what they have/have not allowed
Sunk
My partner has just had his telephone interview with OR, (I didn't have one).
Just to give an idea of what the OR would/would not allow.
We are a family of 5:
2 adults
3 children 17,15 & 13.
The OR allowed £600.00 for house-keeping.
My partner disagreed, OR says I know that seem low but that's what the government says is acceptable to live on.
2 mobiles have to go, only allowed 1 at £40.00 per month.
No internet.
No sky tv.
They will not allow these luxury items.
My partner argued the internet is used as I home educate, so they are questioning if they will allow that.
Petrol was allowed at £250.00 per month 2 cars.
We are rural & I do college/school runs at 64 miles a day, let alone what partner does.
So fuel has been allowed.
I don't want to sound arrogant but I am NOT getting rid of 2 mobiles, internet & sky, which is the lowest package of £23.00.
I don't drink, I don't smoke so do they want to take all my enjoyment.
Part of me is thinking what the hell, I can't deal with this, slap a BRO on me, who cares, I'm going underground, do not disturb, I not answering any questions.
Yes I'm rambling...., not much help for some on here, but just so peed off.
Who says it gets easier going bankrupt.
Why the hell don't the government live in the real world with regards to bill/costs of bringing up family etc.
Rant over....

Hi,
Have they allowed you £ 80 - £ 100 per month for a family holiday ? Haircuts ? If your not happy with the proposed Income Payments Agreement then dont agree to it. The OR would then have to take it to court and let the judge decide what is acceptable for the domestic needs of you and your family.
The insolvency rules are there to make sure that you are not so tightly restricted as to be forced in to a spiral of debt once again.

£100 a month for holidays? £1200 a year? thats generous int it?0

Hi Max,
I dont think its that generous. The bankrupt is meant to have reasonable expenditure and not be limited to basic income support levels. The insolvency service technical manual states that £ 60 - £80 per month s resonable for a family of 4 for a holiday fund. I take that as £ 20 per family member hence £ 100.

hi Sunk
Did you actually get an IPA? How much was it for?
They've been trying to force me into signing one and I have resisted so far. I was also not allowed net/tv but have kept them and am paying for them out of surplus, TV might have to go soon due to my hours at work being cut down (my choice) but I cant let my net go, no way its my lifeline!Sometimes you have to go throughthe rain to get to therainbow0 -

I did not put anything for holidays...what's a holiday?
Nothing for treats as I was sure they would be refused.
Hairdresser I put £30.00 per month, which was excepted.
The only luxuries were net/sky/mobile, which has been refused.BR 08/05/2008

I have not received an IPA yet, the OR wanted to ask a few questions first, so will be receiving one soon.
From the looks of things, things will be tight & as you said DD this could put me into debt again if I have these restrictions.
So far I am not in agreement with the OR.
When I voice my opinion the OR says: Government policy.BR 08/05/2008

Then I would contact the OR and say that you wish to put at least £ 80 per month in for a holiday. Most families would try to have at least a modest holiday if they were working and a bankrupt should not be treat any different in this respect.
Did you allow at least £ 100 pm for clothing ?

 So I should ring the OR again & say:
'what about my holidaymoney...forgot to add that'.
That would then 'up' my household expenditure as I wouldn't use it as holiday money.BR 08/05/2008
