    I've been offline for a while (ISP trouble) but now I'm back on I thought I'd drop in to let everyone know whats going on.

    The court hearing was a, er, laugh. Firstly they got me confused with another person with a similar name. I was sat there for ages looking astounded at accusations of not having paid more than a fiver since february of this year before I realised and pointed out their mistake.

    Then once they finally found the RIGHT statement from the council there was a discrepancy of about 800 in the amount owed.

    The representative from the CAB tried to push for a suspended posession but the person from the council was basically saying 'no just evict them either way the amount owed is large'.

    The final decision was to agree payments of areers + five pounds each week until a new hearing could be arranged.

    I'll be seeking advice from a solicitor during that time. The hostility of that council woman really shocked me.

    I was under the impression that the CAB / CCCS/Payplan/national debt line all did the same thing? I hadn't called national debt line because I thought they'd only be able to offer the same advice the others did and I didn't want to waste their time.

    You've mentioned them a few times though debt free chick - do they do more? I'll certainly give them a call if they are a different kind of place.

    Thanks again everyone for all your help and advice, I'm still dreading the next hearing but it's looking a bit better.

    hi there....so sorry to hear about the whole messy situation i got myself into abit of a mess too ...i was studying (part time like you cramming 2 years into 1 ) realized i coundnt afford it and was getting deeper and deeper in debt so had to give up college and go back to work ....i know this isnt any advice but that was my way of getting out of it....illl go back to college once im more secure (moneywise) good luck

    Yes they do the same thing. However, I understand that Payplan & CCCS prefer to see your whole financial situation before they advise. And Payplan will only take you as a client if you have at least £100 per month excess income to pay your debts.

    ND will give you advice, over the phone, on any single aspect of your finances. I originally urged you to call them in view of the difficulties you were having in getting hold of CAB. I thought that ND would be a quicker source of help.

    Are CAB continuing to help you? Are you getting legal aid for the solicitor?

    If CAB are continuing to help, then stick with them. But no harm in giving ND a call. They will help, if they can.

    Or at least take a look at their website as, unlike the other debt management companies, they publish a very comprehensive range of factsheets on their site - for free ;D

    The Council will pursue the case "enthusiastically" ;) but the Courts are used to this. The Courts will see fair play. If you want to pay and can pay the arrears, it would be unusual for the Courts to evict you. They don't simply side with the Council, they look at what's fair.
