Moving House OH Been refused time off...!!

Hello - bit long sorry!

We are moving house tomorrow (Friday). OH rang his work on Monday to let them know he would need Fri and Sat off. Bit short notice but we only had the date confirmed on Monday.

He couldn't get through to his manager so he left a message with reception and stressed that he must get the message. We then went out and didn't think to follow it up...not even sure what time his manager finnishes...anyway...goes into work on Tues and tells his supervisor that he would be off Fri & Sat.

His manager is not in on Tues and Wednesday - they are his days off.

Goes into work today, manager comes over at lunch time, supervisor has told him about him wanting 2 days off. Manager says first he has heard of it and he has no chance of having the time off. HR said he should have spoken to his manager himself on Monday, explained that he tried but couldn't get through, HR shrug shoulders.

Now, I have 2 babies and a 6 year old. Plan was for Oh to take 6 yrs to school and 1 baby. I take other baby to mother in laws, drop her off and collect my f-i- law to help with the move.

Can he take the Friday off as parental leave and therefore give no notice?

    Statutory parental leave can only be taken in one week blocks, and you must give 21 days notice, so it would not be applicable in this situation.
    Gone ... or have I?

    yet you can't take depentants leave either if you know in advance. so what if you know in advance but not 21 days in advance?

    or could i wake up and go out before he goes to work forcing him to take dependants time off as an emergency and take daughter and baby to school...sounds a bit drastic eh?!

    I agree the provisions do seem to contradict their purpose!

    My feeling is that because they know that he wanted the time off, if he then called in asking for emergency leave, they would not be happy. I have seen instances of this that have ended in disciplinary action.

    Is there any chance that the mil could have all the kids? I know it isn't always that practical, but is it a possibility? x

    perhaps she might, it's just that she is not able to carry any of them up and down stairs. One is 18mnth and the other is 6mnth so it's a big ask! But with 6yr old helping her she might say yes.

    I'll see what happens with Oh gets in from work... he is already 40 mins late...is that good?! lol

  • He doesnt have any right to that day off and has had it declined

    I suspect any attempts by him to circumvent the decline of Annual Leave will result in dismissal on the grounds of gross misconduct

    I have never seen an instance of one day's unauthorised absence (which is what they would class it as if it was not deemed to be allowable) that constituted gross dismissal. It would possibly be a written warning, at worst a final written warning?

    Could potentially be dismissal for one instance of unauthorised absence if he is in his probationary period; but otherwise as DMG says, very unlikely to dismiss.
