What do ya all think to this then? Are we being tricked?

right folks here we go. We have been threatened 2 months ago by a dca called marlin with court proceedings and ccj and charging order for a debt that is being managed by dma payplan. Marlin bought the debt from a dca called metropolitan last year and sent us a letter telling us. Nothing has come through post from marlin or the court but metropolitan have started writing to us ,1st they said we had defaulted on the payments, we wrote back explaining about payplan. They then replied accepting 'our offer' which was when I checked on payplan web the payment that is going to marlin we are writing back to both marlin and metropolitan and sending them both copies of the original letter that we got from marlin confirming the buy out from metro and we are going to ask them both to confirm who owns the debt because we think that all this is actually from marlin trying to trick us into changing our standing order details to that for metropolitan so that they can then claim default and take us to court.Are we right what do ya think ?

    I would send a letter asking them to provide a signed copy of the original credit agreement that would sort things out for you.

    thanks I've just been reading the thread about lyods and breaking oft regulations i think this is happening to us via hsbc as we have letters from 2 different dca's for the same account

    I agree ,you have been paying , now they are trying to be smart ! Well many people are finding that often a debt which is sold on to these sc--m bags when there is no enforceable CCA .Also request a deed of assignment . So have a look at my thread LETS ALL ASK FOR OUR CCA . But remember do not call them or speak to the them if they ring you. Anything said or agreed on the phone is not worth the paper its written on . Please let us know how you get on .

    thanks will look at your thread and will keep you posted they are scum bags we are not stupid ,but if we took our eyes off the ball for a second they'd try and have in court like a shot.havin just spoke to th hubby we are also gonna send a letter to hsbc who we originally owe and ask them to clarify who the dca is all letters will of course be sent recorded delivery.
