Moorcroft...help!

Hi Everyone.

We have an unpaid water bill of £750 :eek: ....moorcroft are now dealing with it. I haven't spoken to them yet, but they've sent a letter threatening bailiff action, court action, attachment of earnings etc etc. we are up to our eye's in it as it is I can prob only afford £10 a week at the moment.

do you think they accept it?:confused:

    Hi Dotty,

    Try not to worry,

    Moorcroft don’t have the power to do any of the above. The only person that would is a court and that is if you default on a CCJ. So as long as you don’t have a CCJ with them you will be fine.

    When you come to an arrangement with them, don’t that them back you into a corner – offer them what you can afford to pay. When you are offering them the reduce amount you need to have control of your payments so I would suggest either paying by standing order or payment book rather than direct debit. If they say they are not accepting the payment – send it anyway!

    If there are other debts that you are also struggling with, CCCS have a free online debt advice system called Debt Remedy – you input your income and expenditure and the system will let you know exactly where you stand and the best way forward. This link will take you directly to Debt Remedy.

    DCA's / Creditors NEVER accept an offer of payment, unless it's in FF settlement, however, you should only pay what YOU can afford.

    Are you on any kind of payment plan?

    If you are having financial difficulties, it may help if you can post your SOA (Statement of Affairs) here.

    It may well be worth you seeking further advice from one of the debt charities, click here.

    I've no doubt the letter you've received from Moorcrap is from one of their "Pre" get heavy departments :rotfl: don't worry about it, the words in the letter are bigger than what Moorcrap will ever be.

    Well in that case, offer what you can afford, if Moorcrap refuse, inform them you are going to apply to have the CCJ set aside for independent adjudication re your offer.

    i already have a ccj with water company, but for smaller amount. i've never paid anything off it.

    If you already have a CCJ is this for the same debt or another debt with the water company?

    For the CCJ it’s really important that you start paying this as if you don’t pay it the court has the power to send bailiffs. If you can’t afford to pay the CCJ then you can apply to have the monthly payment changed – to do this you would need to get a form from the court called a N245. The N245 you complete details of you income and expenditure and make an offer of payment of what you can afford to pay there maybe a cost for the form depending on your circumstances.

    ccj is for this debt.

    well i've called them first they wanted the debt settled over 3 months....NO WAY!

    So now they've spread it over 5 months....it's still a lot of money. i think we can do it though, they want first installment by end of the month....I'm not really sure how we're gonna do it, but we'll try i spose. feel sick.

    You need to go back to the court to ask them to re-determine the amount payable per month.
