Cant see a way out

I am in an awful precdicament and cant see a way out.

My partner has been living with me for about two years. When i met him i knew he was he was in debt but understood that he was sorting it out.I have done everything i could to support him with paying off his debts but unkown to me he has been ignoring every letter that has come through and it has now got to the stage where he has Balliffs threating to turn up .

Basically i need to know if they can take what "I" own. The house is mine and everything in it is( I know everyone probably says this) But it is true.Friends have told me that i need to prove everything is mine but how can i possibly do that. I dont have reciepts for everthing in my house.

I dont want to seperate from my partner but he has no money and i see very little chance of him sorting this out.

Please help some one

xxxxx

    Hi

It depends on which “bailiffs” are threatening to turn up.

Are these court bailiffs in regards to non payment of council tax, or just a threat of bailiffs from some creditor / DCA

If you let a bailiff in they will do a walking possesion i.e. seize goods. They will mark anything down regardless of what you say. You then have to proove that they are yours. So don't let them in! in fact don't open the door!! They will try every trick in the book and then some to get into your house peacefully - once they are in they are in (even if it's to have a wee) they can then apply to enter your house by force (locksmith). Keep your cars away from the house they will seize them. Don't sign anything that is pushed through the door. Get your partner to seek advice from either National debt line or CAB he can run but he cannot hide.

    Al the best

OK, well there is a process they have to go through prior to it getting anwhere near bailiff stage, which I doubt it would.

Is this a letter stating they may send in bailiffs?

Is it possible for you and your OH to post on here for advice re his debts?

That way, you could monitor the advice offered is followed through.

Some DCA's send letters threatening to send in the bailiffs - these ones cannot enter your home without permission.

If it is letters from a Bailiff company then do not answer the door to them and make sure your doors and windows are locked at all times. The can gain peaceful entry by climbing through an open window.

A bailiff will have a warrant from a court. A DCA will not. If you open the door to a bailiff, they can't just push past you. Do not let them in under any circumstances. Once they have been in your house once then they will be able to gain entry to seize goods after this.

You need to find out if this is a debt collection agency threatening to send round bailiffs, or a properly appointed bailiff company.

PS - DON'T LET THEM IN - not even to phone the office to let them know the goods cannot be taken. Some may try to trick you like that.
