Hi,
Citicard recently sold my debt to HFO Services. This was being paid back via CCCs. HFO have now written to me saying they are not happy with the repayment terms and want more. They are threatening putting a charge on my property or going for an attachment of earnings if I am not cooperative.
Can anyone confirm where I stand on this and what legal rights HFO actually have.

HFO services buy debts which have NO SIGNED CREDIT AGREEMENT. We were having SERIOUS phone harrassment from ONE GIRL, she would ring and ask for my partner by first name, when I said he was out she said "I try his mobile!" If I didn't already know of her it could have started rows.
One day, after being asked to not ring at 8.20pm as I have kids, (CAB have stated after 7pm is harrassment), we were subjected to the most disgusting and scary 40 minutes, with phonecall after phonecall both on home phone AND mobile (where did she get his number???) she and her mates SCREAMED down the mobile , when we answered it and left it laying around. Around about 20-30 phone calls which stopped at 9.02 (2 mins AFTER they have been told they can phone).
Do not pay them!!! They have no legal right to harrass you, and whatever you pay will not be enough, I complained to BARCLAYS as it was their Credit Card debt and nothing came of it, I am going to the ombudsman.
Our debt was given to someone else, who did the same thing, NEVER asked any security Q's.... Get an answerphone as NO-ONE ever wants to leave a message.....SILENCE!!!!!0 -

Thanks for the reply, it seems like a few people have had similar problems with these cowboys. Were you just receiving phone calls or were they writing to you as well? All I have had so far are two threatening letters but no phone calls. I wondered whether these letters had any legal validity or if HFO were just using scare tactics.0 -
Give CCCS a ring thats what you instructed them to do handle your DMP and take the stress out of it!
They are 99% probably just trying to squeeze some more stick to your guns, the courts would not be happy them dragging into court when you are already in a payment plan.0 -

Read the OFT Guidelines, then send them for the telephone letter

Not only should you start quoting it to them , but advise them that all phone calls will be recored to serve as evidence when you complain to the OFT and Trading Standards.

If this is OH's debt and they are in any way discussing the fact that he is in debt with you, not only are they breaking OFT Guidelines but possibly the Data Protection Act.If you've have not made a mistake, you've made nothing0 -
