Hi all,
A friend of mine has been having probs with a debt collection agency. She had a debt about 13 years ago which she beleived she paid off. seems now that she did not and they obtained a CCJ in 95. They are now seeking payment as they have found where she is now living - can they do this? they are talking about enforcing the judgement but 6 years has passed since date of judgment so can they do this?

Any debt that has not been acknowledged in writing or had any payments within 6 years is statute barred. After this time the debt will fall off her credit file and is unenforceable.

Hi guys
if the CCJ is more than 6 years old and the creditor made no attempt to collect in that period, then the current "CREDITOR" NEEDS TO GO TO COURT TO GET PERMMISSION TO PURSUE THE DEBT.
