Right after sorting my last problem i have another one :-(
Last year i shared a house with a guy i knew. In December I moved out and he stayed in the property. I left him money to pay the bills up to date. Well he stitched me up by not paying them. Turns out landlord put them only in my name!! Well i moved to cornwall none the wiser. I have just moved again and this time have had a letter turn up from the county court! It's an online claim by the gas supplier.
I rang them up and explained the situation and that i had just started work 2 weeks ago so couldn't pay the full amount straight away £341!!
They said pay £100 in two days and once we've seen the payment go through we'll discuss a payment plan and stop the CCJ going ahead.
So i sit here for two days waiting for the giro slip to come. Today a letter came asking me to complete the claim forms and return them and no giro slip I am very confused. If i complete the forms accepting the ?
Help how do i stop this without having to pay the full amount now?
I have the ext number and name of the person i spoke to but want advice on how i deal with my calls back to them.

What claim forms have you received?
Can't you simply call them and pay £100 by switch? If not, can't you send a cheque directly to the person who sent you the claim forms and tell them about the conversation you had?Warning ..... I'm a peri-menopausal axe-wielding maniac

I do not have switch i was bankrupt a couple of years ago. Or a cheque book.0

When you say claim forms do you mean the court supplied forms laying out your living expences?
Anyway. I'd send them a small payment, say £20, and a letter laying out your income and expenditure with a suggested payment from you. Then see what happens.

My original post said what they were . From the County Court, online claims forms. In other words they made a claim through the online county court servce. Stamped by the county court. County Court proceedings i have 14 days to reply. The normal stuff. Sorry thought it was obvious.0

have you not got proof of when you moved out so that you dont have to pay it seems a bit unfair that you have to pay someone elses bill.0

One way or another you need to respond to the court form. If you can show that the debt relates to the period you were not living there then that should be a 'reasonable' defense. What do others think?
If you end up with a judgement to pay the whole amount within 14 days, you can still 'vary' it to a monthly payment on an N245 form from the court.
If you're admitting the claim and asking for monthly instalments at this stage, remember the form goes back to the claimant, not the court.0 -

I did not say the bill referred to a period i didn't live there. I gave him money to pay my half of a joint bill i was half responsible for. He then did a runner without paying the bill. My question was how do i STOP the county court judgement going ahead. I know what happens once i get it. I need to make sure i dont get one as I'm temporarily living at my mothers address. the only way to stop the CCJ without agreement from gas company is to pay it in full.
if they have agreed payment plan and will withdraw the CCJ (have to admit seems unlikely as they have already paid the fee to the court) then put this in a letter with the court forms completed (that you admit the debt and offer to pay by installments), copy and send to gas company recorded delivery.
i know the account was in your name and someone ran off without paying, it may be worth adding this to the letter and have you checked they are billing you for the correct amount and not for after you left, if they are send the defence form back to the court.
if you do get a CCJ if you pay in full within 14 days its not recorded on your file (this is because sometimes people have a dispute and lose, they can they pay and not have credit affected)Ready to Go Go!0
