Robinson Way

Hi - wondered if anyone can advise my friend on the following problem please?

Robinson Way – no signed agreement...
Quite new to posting so hope I’ve got this in the correct thread. Thanks to everyone on this site for the marvellous advice, and for giving encouragement to those of us who are perhaps a bit timid. Regarding Robinson Way. I followed the advice and sent the template letter asking for copy of cca and breakdown of the account. They responded within 3 days with a letter saying:
“Please find returned your payment of £1.00 as no signed agreement is available on the account.
Please note that we may not be able to enforce the debt as no copy agreement is available. However, this does not mean you are not liable to pay the debt. Please continue to make your monthly payments as arranged.
I trust this clarifies the situation in hand.”
Briefly, this was approx £6,000 loan from Abbey in 1991 taken out in my name for the use of my (now) ex-husband. I have never felt morally responsible for this debt, but willing to accept legal responsibility. Since the debt was passed to Robinson Way in 2000, I have been paying a nominal £1 per month to Robinson Way and the debt is now £4,800.
I am now at a loss of what to do so wondered if some kind person would be willing to advise my next step. Should I reply to RW saying that I will no longer be paying? Should I just stop paying and not contact them? Should I just keep paying the £1 a month anyway as it is such a small amount?
Thanks

Now is the tme to stop paying Robinson Way.

Strictly speaking they are right. The debt does still exist, just that if you stop and they try to enforce it in a court of law, then they would be told to get stuff (or the polite legal version of that).

Your friend might want to ring the national Debtline just to get confirmation, see here to the contact details.

And since you are on here, go over to one of Stapeley's CCA threads and report your success. It will hearten others.
