help needed alliance and leicester threatening ccj/bailiff

Please can someone give me some advice. I am new to this site but have been reading it for ages .In process of setting up a DMP myself have 8 creditors alliance and leicester have sent me a letter today saying potential commencement of legal proceedings . They say i am ignoring all communication even though every time i recieve a letter i respond . I will not talk to them on the phone .i have sent them an soa What do i do thanks:confused:

    This is computer generated by something that does not bother to check your situation, being programmed solely to deal with accounts with a default.

    You could try writing to them reminding them that contrary to their letter you have written x times and sent your SOA, but not had a substantive reply, just to get something on file.

    Are you sending them any holding payments? if not, what do yu propose on the basis of your SOA. Set up a SO to pay that each month anyway.

  • Thanks Ras I have told them i can only pay £14 /month which i have sent and they have cashed .Am about to send them another £14 for this month as its all i can afford .I had major surgery a month ago and my income has reduced dramatically . Feel very scared at the moment about bailiffs coming to my house etc .

    Hi,

    I had a letter from Mercers, they have the same address as Barclaycard and Payplan assure me they are just part of Barclaycard. As Barclaycard had already accepted my DMP, I just wrote back suggesting they checked there files and that was the last I heard from them.

    Barclaycard were ok with me once they had received my offer from Payplan.

    Please take it gently. Loads of DCas write awful letters referring to the posibility of charging orders, bankruptcy and bailiffs and nearly all of it is bluff and blunder.

    What you will find it that the letter referes to the fact that this may be a consequence. Very carefully worded that may, as it gets them off the hook with the OFT re misleading debtors.

    Ok, you have defaulted. If BC were to take you to court to get a CCJ, then the judge will order you to pay £14 per month. That ruling will be binding on you and BC. If you fail to pay the £14 each month, then BC can go back to court and ask for the bailiffs. So there is a long long way to go and if BC can see that you are paying what you can they may well decide to just put up with it.

    But by the sound of it that is not likely to happen if you can help it, anyway.

    No they are only entitled to your Income and Expenditure. They have no right to ask for anything else. Just send them your SOA again and politely mention this is all they are getting.
