Sorry , but I believe you have gone about this all wrong ! You are disputing a debt ! They say its one amount , you believe it is different . If they want to take you to court , you are entitled to request all paperwork relating to the account . If when you receive court papers you request all monthly statements and a copy of the true signed agreement they must comply . If they fail to provide a CCA it will not go as far as court , if they can not provide all statements they can not prove amount claimed is correct .
When filling in court paper you do not have to put in a admision at this stage , just that because untill you receive the requested paperwork from DCA you can not confirm that the debt is in fact correct .0 -
Sorry Stapeley but I disagree slightly with you on this one (in the nicest way possible!). The OP has already received a claim form and replied with a part admission which has been rejected by the claimant and is now proceeding to track - hence having received the AQ.
May - you should still do what Stapeley and RAS have suggested but the Allocation Questionnaire will still need to be filed before the 29th May.
Try the link below to Community Legal Services to see if they can offer you any help on completing the AQ as you can ask for a months stay for settlement which will give them time to comply with your CCA request.

I will request the cca and fill in the form and return it. In the mean time I shall also try and get some further advice - but how do i go about requesting a 'months stay for settlement'?0 -
Just as an update, i sent a request to capquest on 29th May requesting statements and the original cca. I sent my allocation questionnaire back to the courts. I have received a copy of the allocation questionnaire from capquest and a letter from the courts stating a month's stay of settlement until 5th July.
I still haven't heard from cap quest and received no paperwork from them.
Any advice? Not quite sure what i should be doing now.0
