Rundle Co Bailiffs coming TODAY? / TOMORROW

As you probably guessed i am usually on here under a different name...although i don't think i have been on the debt free bit before....
anyway here goes....

Hi

i am hoping someone can advise me,
i am going to write this in very simple terms as i am shaking and crying.

NOTE at this moment in time no bailiff has even knocked on my door

Rundle & co contacted me and i began an arrangement with them for £75 per month. this was all they said they would accept.

i only made one payment since feb. that is the only payment i have made them.

I called them today as recieved another letter. they put me through directly to bailiff who was very abrupt and said no arrangements can be made he is attending tomorrow to remove goods.

i did a bit of reading and realised amount he stated to be more than when i made original payment.

contacted council and they said amount passed on was for £766.50 yet bailiff quoted £965

i then called him again and said i had been trying to find out my rights and was confused about the amounts and asked him again to set up an arrangement with me.

he said no and that his working hours were between 5am and 9pm and that i may get a call later today

he said 'i am now going to do all i can to recover the amount owed'
and that 'once it gets to recovery stage fees are applied'

confused scared and crying sad.gif

my daughter has autism and hates loud noises etc and stress...this is going to be awful.

i can't talk to the bailiff iin person...'m too much of a wimp and will become a quivering wreck.

i understand its my own fault for falling behind last year but please don't be too harsh with me smile.gif

is he going to knock on my door tonight???eek.gif

how long will he wait around if i don't answer?
what if he gets the police involved?

    Firstly big hugs to you
    The bailiff can not remove your goods without a walking possession order and if he hasnt been in your house he wont have one , if he calls tonight do not let him enter your home he has no legal right to do this , as for calling the police the law is on your side especially if he frightens you just call the police yourself and tell them so

    First of all calm down, at this point in time the bailiff has as much rights as you want to give him. If none at all then don't even answer the door. The bailiffs charges are way over the top, £24.50 for their first visit and £18 for their second visit, if you do not open the door for them to come in, then this is all they can charge. They cannot charge for writing you a letter. There are a number of things you can do:

    Have you asked the council to take the debt back given you personal situation?

    Phone the national Debtline and explain to them the situation

    Bailiffs need to be certified to collect Council Tax. 2 ways of finding out 1. ask herbie 2. phone Her Majestys courts Services headquarters - Enforcement Program on 020 7210 0516 with the name of the bailiff and they will tell you.

    They can not take goods without a walking possession and they cannot get a walking possession if you don't let them in. Contrery to belief the police (who will attend if you ask them) are there to see that both sides do not break the law BUT! my experience says they do not know the law so they take the bailiffs word for it - so be careful.

    SO DON'T OPEN THE DOOR AND [EMAIL="DON@T"]DON'T[/EMAIL] SPEAK TO THEM - IT will cost you £24.50 (first visit)
    June 2005 = 48K of Debt:cry:
    Sept 2006 Started dmp = 56k of Debt (inc fees and charges) DFD April 2030:eek:
    May 2008 = <5k of Debt (CCA route -48K, paid off 3K) DFD April 2010
    Nov 2008 Lloyds found CCA for 14K loan:mad: New DFD Jan 2016

    Happy so far tomorrows another day:confused:
