Re determination?

Has anyone got an idea timewise of how long it takes from the time you have asked for a re-determination? Seems like Ive been waiting weeks, last info was that the case was being transferred to a local Court for hearing? About 3 weeks ago... Im not keen to go but obviously would like to stop worrying:eek:
and get it sorted out.....

    I asked for a redetermination hearing and it took a few weeks. you should get a letter with a court hearing date. go prepared- i got what i initially offered as it was clear my finances couldn't cope with more than that.

    It can take a while depending on the work load of the court it has been transferred to - if you are worried that you havent received anything give them a quick ring and they will tell you what is happening with it. x

  • We are going for ours next week and the week after, as we have two to go for. We asked for ours to be redetermination back in December and January!

    Just to let you know I phoned the local court yet again, as I received back the 2nd redetermination which had been trandsferrd to local but still hadnt received the 1st one back. I was really worried that something had gone missing somewhere and of course the court would blame me?? anyway the court house lady had a serious look through the files after advising there was a 6 week backlog? and found the 1st one had been stuck back in the '' to be scheduled' box what ever that means?? anyway getting to the point if i hadnt harrassed the court house they wouldnt have dealved through the files and found my lost redetermination form and now I am lucky to have 2 on the same day!! A learning point the court assistants are very stretched but do help if you explain why you are so concerned, in my case the 1st file was collecting dust, but has thankfully been recovered...
  • Ive had 2 re-determination hearings and both were nearly 3 months after the original judgement.
    Like otheres have said, make sure you go prepared with your Financial Statement so that you can show the judge your exact situation.
    Also it should be an open court, meaning that you can take a friend or reletive along with you for moral support, this really helps!
    Finally if your worried about your creditor sending a high powered lawyer, dont! in both mine the creditor didnt send anyone and the judge said it was very rare that they do.
