    Legal Aid is available for this type of thing in some cases. However a legal firm would have to make an application to the Legal Services Commission, this involves a lot of paperwork and they are taking the risk that the Legal Services Commission might knock it back and them then not getting paid. This is probably whilst you are having problems finding a firm that will take it on. It is nothing to do with Claims Direct or any other Claims Management Company.

    The firm I work for usually only take this type of work on for existing clients, we are only a small firm and cant really afford to be taking risks.

    I can only suggest that you keep trying, try looking for a large firm that specialises in debt and bankruptcy. Alternatively, head over to the Consumer Action Group, which is a great forum site with lots of qualified people giving advice.

    I have tried to read this post as best as possible but I have a five year old pain in the bum moaning down my ear, but what struck me most, (if I read it right that is) that you put the debt into dispute (by requesting documents) and yet they continued to Court to make their application? Hmmm there is so much to look at in this case. Perhaps, when you contact a legal firm, if you were to mention that you feel there might be a substantial claim for charges etc they might be more willing to take a look at it for you??

    I was under the impression that legal aid was scrapped for the Customer Fee Agreement, no win no fee, type claims. If there are exceptions then I apologise but i think that in the main people will struggle to find solicitors for these cases on a no win no fee basis where their claim is not reduced to cover costs etc.

    My reference to the claims companies mentioned were the fact that Claims Direct went under because of their exploitation of a flawed system. The claims that they were submitting included premiums of £1200-1500 for the work they did and the "After the Event" insurers wanted accountability of this fee. When this happened, cases started to be lost and the company left a lot of people in a mess.

    At the end of the day, there are options and there are questions that lenders need to provide the answer to and the reality is that there are laws to help. Its just finding the most suitable way of getting that help.

    Thank you homer_j, for your honesty and willingness to offer your insight and provide helpful information to people who have been mistreated by the financial services industry. Those of us who are desperately struggling to obtain redress from the companies that have ripped us off, are grateful indeed.

    As someone who follows much of what is posted on the board, it comes across clearly which professionals are genuine in their wish to provide unbiased and transparent information to people seeking advice, which are biased, and which have perhaps other motives.

    So thanks again, you and others like you are so very much appreciated. :T

    Just a quick thank you,Homer j, for steering me in the right direction. The case is now being looked at by the specialist you suggested. Although I had consulted them some years ago they openly admit they did not have the financial clout to deal with my case or similair. They now have that clout and have reopened my case, this and the interest from ITN makes me very optimistic that justice will be done. I will keep you posted with events as they happen. Anybody in a similair position i suggest you send a post either to myself or homer j, if I can help I will and i'm sure that goes for homer j as well.:T :j

    Anyone who has been following this post may be interested to know that BBC World Service recently interviewed my family on and I for a series of programmes they are running regarding the effects of repossession on the family.
    The series is being broadcast for a week starting on Monday July 21st as part of the outlook programme, our interviews are scheduled for broadcast in two parts on wednesday 23rd and thursday 24th July - the programme is on at 0930 but is repeated at 1330 and 2305 on all days.
    Whilst this is not a campaign programme it may bring my situation to the attention of others who may be able to help me right this wrong.

    Latest - Having passed this to Loancheck in May 2008...I have just found out that the Solicitor dealing with this was not given any of the information in my post but were asked to look at possible illegal brokerage fees that may have been paid by the building society............I despair.............this has been going on for so long..........maybe I just have to accept that I will have this debt as long as I live...............If anyone CAN help please let me know.
