default on credit report - advice needed please!

hi guys,
I have got a default on my credit report from 3 mobile. this was from about 2 years ago. i had msised a few payments over the course of the contract but when the 12 months was up i wanted to settle the account and end the contract. i paid up the final installment and was told that the contract was finished.
i then never heard anything from 3 mobile to say anything different.
i got a credit report about 6 months ago after being refused credit and realsied that i had a default on my account from this contract!! :mad: i spoke to 3mobile who informed me that it was incorrect and that i had settled and that they would change my report. they have issued it as a settled account but not removed the default.
i have put a notice on my report to say that i have challenged this.
i have written to 3 mobile 3 times now threatening them with going to the information commissioners office and that the default is unfair, however, they keep sending back the exact same letter saying that they appreciate the account is settled, however, the default will remain on my report as an indication of how the account was handled.
i may have msised 2 or 3 payments but surely this is not enough to put a default on my account and also surely they are legally obliged to inform me that they have put a default against my name?
this is seriously affecting my credit rating - i have missed payments on other accoutns in the past but now i have finished uni and am in a stable and full time job i haven;t missed a payment on anything for 9 months. however, for some reason my credit score has gone down (adversely) since i got my last report at christmas time. how can this be??
i have had a few credit checks around that time so could this possibly have caused it to reduce?

If you think the default is unfair, then the next step is to complain to the ICO.
