I will be calling Payplan later today about this but basically, I've just started a DMP through them and I spoke to MBNA about 3 weeks ago to tell them this. I was told this was OK, thanks for letting them know and they will wait to hear from Payplan. Yesterday, I got a letter from Optima Legal saying MBNA will be taking legal action, seeking charging order etc..... Should I phone them/write to them or let Payplan do that?
I paid a token amount this month, and have also written to MBNA to tell them I'm with Payplan so it's not like I haven't kept them informed. :mad: :mad: :mad:

The 'dreaded' MBNA again. :eek: :eek:
They were one of my worst creditors - didn't even 'let go' until three months after my bankruptcy. :mad: :mad:
But don't worry too much, tw. It is common practice for creditors to pass debts on to debt collection agencies as soon as they know that a 'debtor' is in trouble. Payplan (you could also speak to National Debtline - 0808 808 4000 or CCCS 0800 138 1111) should put your mind at rest.
It is most unlikely that MBNA will, in fact, take you to court, and even if they did, the court would see that you are tackling your debts and would be most unlikely to rule in favour of any charging order, or, indeed, to issue an order that you pay any more than you can afford - which, again, is unlikely to be any more than Payplan will reccomend after going through your SOA.
So basically, just don't worry about the letter - show it to Payplan and take their advice.
Finally, you should have a look at the OFT Guidelines on Debt Collection. MBNA, and their debt collectors should deal with your nominated third party - Payplan. If they continue to harass you, report them to Trading Standards.
