Bailiff visit

To cut a long story short my sons girlfriend left leaving behind a £700 BT phone bill. She didn't tell anyone she was going she just went. Anyway i offered to pay the outstanding bill to BT who refused as it was in her name only. They also said to send back any letter for her as not known at this address, which we have been doing. In February this year the debt was passed onto Moorcroft, so again all letters returned back to Moorcroft. Earlier this evening I had a bailiff at the door asking for her. Now I was under the impression that for a bailiff to visit premises s/he has to have a warrant of execution for the courts. Is this correct or not?

It is not illegal to open another persons mail unless you intend to commit fraud - this is frequently incorrectly posted:)

    He showed me nothing except a letter head from Moorcroft.

    I asked if he was a bailiff and he said he was.

    The reason this worrying me is that this nearly tipped my son over the edge as he found her with his so called best mate, the less to do with her the better.

    He was NOT a bailiff, they only get sent through a court.

    I had a visit from Moorcroft myself one friday night, I asked him for the original signed agreement which he did not have, then I asked for some kind of I.D of which he did not have, then I told him he was on private property and he was trespassing..............silence from him.

    Then I told him with out the above documents he could be anybody looking through my 'bin' mail over the past weeks and if he did not leave I would call the police imediently and should leave and never ever return.

    He walked away with me telling him contact only through letter with a copy of the origianl signed agreement and I would authenticate his claim.

    This is not regulated by the Consumer Credit Agreement so the signed agreement is not relvent. What you are entitled to do is write to moorcroft (and BT), advise them that GF has done a runner and that they must remove your son's address from their file on her, under the DPA.

    And get him to check his credit records and disassociate himself if he has any joint accounts.

    And he is just a debt collector, with the same rights as the paperboy.
