Bankruptcy - Trustees ripping us off.

it started with my wife not telling me we owed the rates £2500 and also not telling me they were applying for bankruptcy, we are now bankrupt, with add ons the bill was £5000, the trustees reckon they have found extra debts, another rates bill of £11000 !! a tax bill of £6000 which i don't owe as i am ongoing with the tax, as i am self employed, they have now sent me final bill of what i owe and it's £49,000, allsorts added on, the trustees are charging £12,000, i am getting the info on the rates as they don't have any record on current accounts, the tax man is going to sort it out, how can the trustees find these so called extra debts that i didn't know about, anyone else had this problem, and what do i do about it, HELP!!!

    If you are bankrupt then surely any debts they find that can be written off would be beneficial..?

    Not if you have then got to release equity to cover the bankruptcy costs.


    I think you would be advised to post this on the BK forum as they would have more experience.

    It certainly does matter.

    If you disagree wit your debts in bankruptcy, then these should be disputed, initially with the Official Receiver or Trustee.
    It is, however, true that, if you were both declared bankrupt, then all debts, with very few exceptions, at the time of your bankruptcy, would have been included in your bankruptcy.
    The real problem arises where there are assetts, such as a house, as RAS has correctly pointed out.
    It is most uncommon for a creditor to petition for a debtor's bankruptcy for a debt of £2,500, although it is usually Government Departments (specifically HMRC) and Local Government Organisations who tend to 'use' the option of bankruptcy since they are totally unconcerned with the cost (after all it's the tax payer who picks up the bill - just like their wages - so why should they give a damn?).
    You have been advised to have a look at the Bankruptcy Sub Forum, of this board, where you will receive some excellent advice.
    I would further advise you to talk with one of the Debt Counselling Charities, such as CCCS - 0800 138 1111 or National Debtline - 0808 808 4000. It could be possible, given the amount for which you were declared bankrupt, that your bankruptcy can be 'anulled' through a Full Settlement IVA, but DO NOT GO TO, OR REPLY TO, ANY OF THE IVA FACTORIES WHO WILL BOMBARD YOU WITH OFFERS OF 'ANULLMENT' ONCE YOUR BANKRUPTCY IS PUBLISHED.
