Just to note the other side of the coin - I got a cheap bush 25" telly over 7 years ago now and it's still going *painfully* strong. When will I ever get an excuse to get an LCD?? :)

Rather off topic, I know, but just to say they're not all bad.

I helped one of my husband's customers get a refund on an LCD telly that was 15 months old. Wrote to the manufacturers, I think it was a Bush one too. Definitely write to the manufacturer with anything like this, and if they reply saying that the guarantee has run out, ask them why they manufacture tellies that they only expect to last a year. If all else fails, contact someone like The Crusader in the Daily Express, or watchdog even. Never give up until there are no options left.

One thing I always do - if I am complaining I always do it snail mail, I find people pay more attention to actual letters!

    Good luck.

The actual contract is between the OP and the retailer, Argos. The OP can't enforce the Sale of Goods Act against the manufacturer, as they don't have a contract with them. If Argos has an issue with Bush supplying them with faulty goods then they, Argos, need to take it up with Bush.

If Argos fobs you off saying you have to contact the manufacturer or you have misused the tv, write a letter before action to their customer service department threatening to take them to court after 14 days if they don't repair or replace the tv. You are not legally entitled to a refund as you have had the goods for 6 months. However there is a thread where someone submitted a small court claim against Argos over a microwave and received the cost of the microwave and the claim money back.
    I'm not cynical I'm realistic :p

(If a link I give opens pop ups I won't know I don't use windows)

Yes the contract is with Argos, but the "guarantee" has run out. I was just stating what has worked for me in the past, and was not going for the generalised "these tellies are all faulty" idea, just for the OP to try to get some resolution to her problem. It would be a good idea for Argos to be told they are faulty, but they are big enough to turn around and say go away, but the manufacturer will not want it to get around that they are making a faulty telly and will not help their customers!

We had one of these TVs. It first broke just before the guarrantee ran out and was repaired by argos, then after approx 6 / 9 months it stopped working again.

I contacted argos they arranged for me to take it back to the repairer - whereby I was informed that it couldn't be repaired.

When I contacted Argos they tried to fob me off saying it was past the guarrantee, so I juat advised them that they had arranged for it to be repaired therefore it was not my fault that it could not be.

They eventually arranged for me to either have a refund or choose another TV of equal value - we chose another TV, not a bush make and have had no problems with it since - over a year ago.

(they also refunded us the money - but I think that was a mistake on their part which we kept quiet about :)

    I would say pursue it
  • I'm sure Martin did an article about the SOGA a while back. I can't find it.

    Anyway, this article may help....

Hey, i come across these sort of problems weekly working for a electrical retailer, the first 12 months are the manafacteurs gurantee the company you purchased the item from will gladly help you arrange the repair as long as it is no cause by accidental or malicious damage, after this time it is up to the user to prove that the fault was with the product from the first day that they brought the tv and not that the tv developed the fault during the date of purchase til the date of aknowledgment, therefore if you can prove to the manafacteurer that the fault was there since day one of you owning the product then they have to sort the problem out otherwise unfortunately there is nothing they have to do by law as the product has expired the reasonable guarntee period 'Reasonble' being a time period which has no constrants there for can be classed as a few weeks or a year upwards. thats the way the cookie crumbles im afraid, id recommend buying a much better brand of tv that is built to last such as a sony or panasonic you pay more money for them but you get a much better expirence with it as most people will know they are built to last.
