Gardening Leave & Starting a new position?

I've recently resigned from my job of 10 years and they have put me on gardening leave for 4 weeks, the company I'm moving to would now like me to start a week early - is it okay to start a new job whilst on gardening leave and what about tax etc???

    No it's not.

    There will be a clause in your agreement for garden leave that you will have to attend work if required. The point of garden leave is to stop you working for anyone else during this time.

    What were the terms set by your current employer? Is the new position one with an employer which is in competition with your current one?

    I did - I got three months gardening leave and started a new job abut halfway through this period. My old employers were aware of this and weren't bothered.

    Not strictly true, it depends on the terms of the garden leave. I was allowed to start a new job straightaway (redundancy, company moving out of geographical and technical area), but I know someone who had three months garden leave and was not allowed to work for that period (new and old employers in competition) x

    i was given garden leaver as part of my redundancy notice but it was specified i couldnt start work until the end of the period if i was working in the same industry, if i was changing industry i had to advise them and they would let me do it and still get all my payments
