hi can anyone help me. I AM NEW TO THIS SITE , I HAVE POSTED THIS ON THE DISSCUSSION BIT AND HAD A FEW REPLYS TELLING ME TO TRY HERE SO THANKS FOR YOUR TIME
i got my car on hp 3 years ago the cost was 8grand and just short of 2k intrest, i didnt check the aggrement fully and missed out that i didnt have payment protection. i have been on long term sick since sept last year and was able to pay my payments upuntill jan this year, i contacted the hp company and offerd to pay a token payment every month. they have now took me to court and they didnt turn up, inow have to wait for a new hearing date, i have paid just short of 6k and the short fall is just short of 4k, i have offerd to pay as much as i can untill i go back to work and then i will try to pay more. i need to know can the court make me give the car back even if i am paying something ever month.

I think with Hp agreements if you have paid over half you can return the car to them..check the smallprint to see if this is the case.
However if not, then they can repossess the car and chase you for the rest. Although they may settle as costs of repo and also selling it on mount up.
The problem with HP is that you are not the owner.... There have been a few threads discussing this issue with HP, so it may be worth searching for them as they will have lots of advice in them..in the meantime I really think that you should go to th CAB with this as they will have specially trained legal folk who can sort through your original agreement, and advise you on the best way forward.
Good luck with it all BOB xBlackadder: Am I jumping the gun, Baldrick, or are the words 'I have a cunning plan' marching with ill-deserved confidence in the direction of this conversation?
Still lurking around with a hope of some salvation:cool:0 -
