Hi, I have had some great advice on charging orders in the mortage forum have a look there. We are in court ourselves in June!!

Do a search in the mortgage forum for remortgage with a charging order should bring it up. Also I got a lot of info sent from the National Debtline, they also have a website where they have fact sheets on Charging orders, definetly worth looking.

    Good luck

hi, obviously its down to your particular case but in general i would say that creditors generally get charging orders made final.

We have no equity in our property (about even) and northern rock have just had a CO for £29k put on our house, I couldnt attend the court but put a letter of objection in saying all the reasons why it shouldnt be put on, theres a list of national debtline website, the charging order was still made final even though they are likely never to get any money back.
We even went BR just before (lots of other debt) it was made final and they still put it on, our official receiver is now trying to get it removed.
