Those of your creditors who have NOT provided you with a ca, within the prescribed time scale, have now committed a criminal offence.
You need to report this to Trading Standards and the Information Commissioner, in order to put those creditors in 'default'. Unfortunately the ICO does not appear to have much of a track record in initiating criminal proceedings aganst creditors who have not provided information, as required under the Consumer Credit Act, 1974, but you do need to go through the motions, otherwise these 'debts', which are now irrideemably unenforceable' may surface at a later date, possibly via a different dca, and you need evidence to prove that they are unenforceable.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Ok thanks. And what about those who have replied saying they don't have my CCA? Is there another letter to send? This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -

Not that I am aware of - have they said that they will no longer be pursuing you?
You might find it useful to have a quick word with National Debline - 0808 808 4000 or CCCS - 0800 138 1111, they will be quickly able to clarify the situation and point you in the right direction of any possible letters.I am NOT, nor do I profess to be, a Qualified Debt Adviser.
