Hi everyone
A few weeks ago I posted saying that we were struggling badly and you kind people put us in touch with Payplan (via the Citizens Advice) This is the first month that we have had bills that we just cannot pay (we've been robbing Peter to pay Paul for quite a while now)
Anyway we have decided to go with Payplan and its a good job because the phone calls started tonight (one of the credit card firms phoned, OH said he couldn't pay anything over the phone there and then and they said they would ring again, twenty minutes later another person phoned )
Is this how often we will be getting calls until its sorted?
On the up side even though nothing has actually happened yet I do feel a little more in control:rotfl: :rotfl:

FORMAL COMPLAINT UNDER THE CONSUMER CREDIT ACT 2006 COMPLAINTS PROCEDURE

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.
I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)
I now require all further correspondence from your company to be made in writing only.
I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.
If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.
Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.
Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

Payplan should be fairly quick in contacting your creditors and at that point I would presume that they deal with payplan directly not as there no real point in contacting you once the DMP is underway,
A few creditors and DCA might still contact you but you should just point them in the direction of Payplan,
I wouldnt send the harrasment letter out just yet as I dont really consider 2 phonecalls in 1 evening particulary excessive just annoying.
Also with the letters try and get payplan to send them on your behalf as you want them corresponding with payplan not you0 -

OP, this is the letter you should send if you want to inform your creditors you are on a DMP:

I would like to inform you that I am having difficulties raising the monthly repayment of XXX due to YOUR PERSONAL CIRCUMSTANCES. I am seeking help from DEBT CHARITY NAME and intend to shortly produce a statement of affairs / repayment plan.
While I seek advice, can I ask you to suspend enforcement action on this account for at least 28 days, and also charges and interest? I am aware that you have a good reputation for going beyond the Banking Codes minimum requirements to deal sympathetically with individuals in trouble.
Can you also send me any policy documents / information leaflets etc you produce for someone in my circumstances?

Payplan won't send any letters, they will only send your I&E to your creditors.
Chez000, you really should do some research on this forum prior to giving advice.
OK I didnt realise that there was a limit to how involved payplan got, I know what the CAB would do and had presumed that CCCS and payplan would do the same.
Obviously the presumption is incorrect, but thanks for pointing that out0
