Direct Debit - advice please

Hi All

Hoping for some advice.

I had a loan via Renault, and was paying with Direct debit.

Around a year ago I got a letter to say they were rebranding as RCI Financial Services, and that I needed to do nothing.

I have just recently received a letter from them to say I haven't made a payment ever since, and they are threatening me to pay off the full amount, or it's time for lawyers/repossession etc.

Now, I fully accept that I should have noticed the payments had stopped - I'm not particularly great at checking my bank statements etc, but it seems to me that having set up a direct debit I shouldn't have to check whether I've paid them each month.

Having called them, they gave me a string of lies about previous correspondence they'd sent to me (of which I have received none whatsoever) and even said they'd spoken to me on the phone about it (an outright lie) and said the best they could do is that I pay off the arrears over the next ten months - more than doubling my payment and leaving me seriously broke. They did admit that they were at fault for not collecting, but said 'they can't check my bank statements for me each month'.

Really, I was just hoping for some advice on this - surely the onus is on them to collect DD payments? Is there anything I can do about this or am I at fault?

Anyway, sorry for the long post, any advice much appreciated.

    Dont want to sound harsh so please dont be offended but didnt you realise that you had extra money in your account each month?:rolleyes:

    I think the best you can hope for now and do is to phone and speak to an Account Manager be polite and explain that there has been a mix up over the DD and see what they will offer. If you dont feel comfortable ringing them again then write to them Recorded Delivery again The problem you are going to come up against is the Finance Company are going to ask why you didnt realise the payments had not been made. But if they didnt set up the Direct Debit correctly then you could point this out to them as well.

    i take it you havent spent the money they didnt take? send a cheque and be done.
    Long time away from MSE, been dealing real life stuff..
    Sometimes seen lurking on the compers forum :-)
