Looking at the right company now and according to the T&C

4.4 The Company agrees that for the Duration Period of this Agreement and in consideration of the payment of the Charges by the Customer it will renew the registration of domain name(s), Hosting fees, Additional services for the Renewal Period.
Now correct me if i'm wrong, but i read this as the company agreeing that for that period of the agreement and on payment of the charges, the registration of the domain will be renewed.

Result! Finally had a reply back from 1&1's billing department (coincidentaly the only email I mentioned the OFT in) and they've agreed to write off the balance as a gesture of good will. Thanks for everyone's input, hope I've highlighted the domain renewal policies differ from Nominet in some cases for those who may not know.0

Amazingly, 6 months later I have received yet another demand from Arvato Finance for the same account, even though I have email confirmation from both them and 1&1 that this account was written off 6 months ago :mad:.0

Write to them stating your intention to report them to the Financial Crimes Branch at Her Majesty’s Treasury.Subject to The Money Laundering Regulations 2003 (see section 6(1) Record-Keeping Procedures) failure to keep accurate records and copies of said documents is a breach of this act. Furthermore, your continuance to enforce a debt you know and have been made aware is unenforceable can be construed as Fraud. By virtue of section 2. Fraud by false representation and by the definitions given in section 5 of ‘Gain’ and ‘Loss’ in the Fraud Act enforcing an unenforceable debt is misrepresentation on your part and a clear breach of this Act.
I would also state that you will also report them to the Information Commissioners Office and will be seeking compensation should this continue. (Usually you can only do this if your interests have sufferred due to this breach). There might also be a case to include notice under s.10 of the Data Protection Act that you require them to remove all your details from their system within 21 days.
