repossesion extension date?

hi i went to court last month and the judge ordered a repossesion order, after i was told it will take around 4weeks for the mortage company to go to court and get a date for eviction. we still haven't got a date but dont think it will be to far away and we havent found anywhere to live. could i apply to the court for a extension for the eviction date? we have a 6month old girl, dont no if it changes anything? thanks

Hi Ash,
What date did the court give you on the possession order? When this passes the mortgage company can them go back to the court and apply for an eviction date by the bailiffs.
When the bailiff date arrives it will be by letter, you can apply for a 'stay' but you cannot use the reason that you have nowhere else to live. I think that ifyou can afford to pay the arrears then you can offer to do this but check with the CAB.
If you have not spoken to your local council then please do so ASAP to see if they can help you and the baby if you have nowhere else you can go.

they didnt give a date , the mortage companys solicitor said around 4 weeks then they will go back to court. council still looking for a place but no look yet. will the ballifs turn up or will i get the choice to stay by letter. is it only if i pay the arrears. could the court make a ruiling if i applied?0

You'd really need to be able to convince the court that either there was a sale going through or that you could now afford the contactual monthly instalment plus something to the arrears. Do either of these apply?0

I am so sorry to hear of your predicament.
I know I've been there mate back in the last recession. I know its embarrassing and hard to do but my biggest mistake was not getting help...the CAB is your first stop..and quickly.They deal with these things day in and day out and dont judge you. So for the families sake a big swallow and get down there.

Also Shelter and your local authority.Living Sober.

Yes, please g and make an appointment to see them. I canot understand why they did not give a date. We are being evicted on 23rd this month because our let is being sold and the council have told us to sit tight until the bailiff comes. The first hearing was for the possession order and they gave us 14 days and then told us after this the LL would have to apply for Bailiffs, they did and we got the letter through last week to give us until 23rd to leave.
Also have a look on the shelter website and try and give them a call (or drop them anemail) but the CAB is your first post of call right now really. Good luck.0
