Direct Bebit for my loan payments...

Hi everyone! I'm new here..not sure I've put this in the right forum but it relates to my persoanl loan so thought would just put it here...please could someone help me with this??

I switched bank from Halifax to A&L and I had a personal loan with Halifax, I had a DD set up for my monthly payment but my problems started when I switched bank to A&L..

When I switched my current account to A&L, they brought all my DDs over but I realised that my peronal loan payment weren't on there, so I called A&L to check out, they said that Halifax supplied them with the list so I called Halifax to check that out. I was told that it was an internal payment transfer that was why it didn't show as a DD but then they took my new bank details and said that it was all set up then and payment would start coming out from my A&L account.

To cut the long story short, after 8 months now, DD still not set up, Halifax and A&L are blaming each other and saying that there was nothing that they could do and that it was the other bank's responsiblity..I decided to see both Halifax and A&L at my local branches, fisrtly I went to Halifax and they were like it's not us it's A&L, so I went to A&L straight after, within 5 mins the bank manager spotted that Halifax made a mistake with my bank account name which they assumed that it was a joint account I held with my partner as it's joint loan we took out!! so problem identited and I called Halifax straight away and they said they'd change the details they held for me.

Surprise surprise, problem still not solved!!!! In the past 8 months I have had to make payments at my local branch which is a real pain!! I had to go aboard for a couple of months earlier and I called Halifax to let them know that I would not be able to make any payments at my local branch and told them to make a note on the system, as usual, every time I called they told me that it was all gonna be fine and DD was all set for the following month and it's never been fine..obviously when I was away, I couldn't make any payments and therefore I missed a couple of payments and now I have a default made against me in my credit report!

I am soooo angry about this as I called every month to tell them that all I want is for them to set up a DD for me so that I wouldn't have to worry about the blooming monthly payments!! I write to Halifax to file a formal complaint about this and they wrote back and they still wrote back and said that it was not their fault and they were not responsible!!! I asked them to removal the default made against me as I believed that it was not fair as I warned them I was going to be away and that it would be impossible for me to make any payments at my local branches, they wrote back and said:

'In respect of your request for us to amend your crdit record, I must decline this issue also. A credit record must be a true record of events. The fact is that payments have been missed on this loan account. That is a statement of fact and cannot be changed. Customers can make their own notes to their credit record if they wish.'

My question is that - do I have to settle with this and there is nothing else that I could do to make them change anything?? I just think that this is sooooo unfair!!! Is it worth making any notes on my report?? what should I do?? I am going to write another letter in response to their reply anyway becuase I do feel that I should let them get away with it..but just wondering what I should say about this default notice on my report...Any advice would be much appreciated!! thank you so much for reading!!

    I would definitely write your own comments on your report. Just remember to keep it clear and concise without any waffle. Try and make it no more than about 200 words

    FINALLY!!! I was offered a one off payment of £379.70~ It really just goes to show that if you have a case then go for it!! :T :T :T

    I don’t want to be judgemental, but during this (very) long period of dispute, couldn’t you just set up another DD at your new bank and cancel all disputes about the old one altogether?

    no you can't set up a DD yourself... it would have to be Halifax that sets up a DD (its not like a standing order that you can set up yourself).

    OP could have set up a standing order from his new A&l account to the old Halifax account to repay the loan.
