Hi guys,
just joined the forums and have got lost in finding out what I need to know.
I have been reclaiming (as many others have) and been put on hold. My bank (abbey) are claiming £248 in bank charges and every month this is upgraded owing more and more to them in interest on the original bank chrges owed. I left £247 in the account and from there it has escalated.
They have told me that my debt has ben passed onto a DCA (debt collection agency) and that I am going to be put on the Default Register. This is all because i told them that they (abbey) have put my reclaim on hold and when I was told I owe them money for the charges, I politely told them that I was putting them on hold until the test case had been resolved.
I then received a letter from them saying unless I paid the outstanding amount, they were goint to send it to the Debt Collectors and also put me on the default register.
I replied in a letter that placing me on the Default Register was illegal because the debt I am in is simply because of accumulated charges and not because I owe them or anyone any money and I will take them to court.
Can anyone advise me about what to say to the DCA when they arrive at my door so they go away and not bother me again?
Also, its because of these trumped up charges I owe them money and can I get the entry in the Default Registered erased?
Can I take them to court without having to pay (I am financially up-against-the-wall being on Incapacity Benefit) too much to do it?

    Answer the door via the letterbox and don't allow them entry. They can only gain entry if they have a court warrant and otherwise they have no right to enter your property. Don't turn your back on them or give them any oppotunity to enter the house. Make sure you shut doors when answering the door and if you need to get something close the door and say you will be back with the said paperwork (put the chain on).

    I think that it is actually illegal for the bank to charge you when you are only receiving benefits into your account. I remember seeing this on a forum when I was trying to reclaim charges last year. Please look into this as it may be a way out? Perhaps you could ask on one of the bank charge threads?
