Hi all,
I apologize if this has been covered, but ...
I got a comp. sip this morning asking me to contact "Thames Credit" in Bromley. Phoned, spoke to a member of staff who advised me they where chasing a debt from March 2003. I am aware of the debt they are talking about, but had long assumed it had been consigned to history, as no contact had been made. I did not acknowledge the debt, and stated that I would like a copy of any and all information they had about me.
He said "its off your credit record, get it yourself", I said "acc. to Data Prot. act I am ENTITLED to a copy of any information you hold about me", he became very irate and unpleasant. I said there is nothing further for us to discuss then, to which he agreed.
Can you guys advise on appropriate next steps? or should I just let it go now?
Many thanks

One of the whizzes will be along in a bit with a defintive answer but personally I would ignore it until they write to you properly to tell you that they now own the debt. Sounds like they were fishing to me.
In my book, if someone gets irate because you want to see info about you that you are entitled to see then they are almost definitely not being legit in the way they are going about theri business.
If you do a search for Thames Credit on this forum you will probably get other stories of people that have had the same thing happen.£34,547 (Dec 07); Current debt: £zilch (Debt free December 2010)

Hello Stoo :hello:
Welcome to the forum, send them this letter, by recorded delivery:
To:
Dear Sir/Madam
Account No: XXXX
You have contacted me regarding the account with the above reference number, which you claim is owed by myself.
I would point out that under the Limitation Act 1980 Section 5 "an action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued".
I would also point out that the OFT say under their Debt Collection Guidance on statute barred debt that "it is unfair to pursue the debt if the debtor has heard nothing from the creditor during the relevant limitation period".
The last correspondence/payment/acknowledgement or payment of this debt was made over six years ago and no further acknowledgement or payment has been made since that time.
Unless you can provide evidence of payment or written contact from me in the relevant period under Section 5 of the Limitation Act, I suggest that you are no longer able to take any court action against me to recover the alleged amount claimed.
The OFT Debt Collection Guidance states further that "continuing to press for payment after a debtor has stated that they will not be paying a debt because it is statute barred could amount to harassment contrary to section 40 (1) of the Administration of Justice Act 1970".
I await your written confirmation that no further contact will be made concerning the above account and confirmation that this matter is now closed.
I look forward to your reply.
Yours faithfully
