Capital 1 PPI claim response Help Needed

Hi All,
Hope you can help, heres a brief history of my PPI reclaim attempt to capital one.
8th March requested statements, which I received within the week
20th March sent letter requesting full refund of PPI plus statutory 8% total £119.12
7th April standard letter in response saying I had a 30 day cooling off period (which I did not take)
15th April wrote back to capital one requesting they look into my case again.
2nd May received reply (dated 23rd April) basically saying the following :-P

Account No. XXXXXXXXXXXXXXXX
Thank you for writing to us again about your payment protection insurance (PPI). I'm writing to you out of courtesy as I've already sent my final response.
Unfortunately as we have already issued you with a final response I am unable to help you further in this matter. I am including a copy of this response for your records.
Financial regulations require me to advise you that you now have the option to contact the Financial Ombudsman Service from the date of the final response letter (7th April 2008). Their contact details are in our complaints leaflet, which I included with my original correspondence.
(Please note, calls to the 0845 number at the top of this letter will be charged at a local rate. The cost will vary depending on your service provider. Calls may be monitored/recorded for training purposes)

Can anyone give me pointers to further my case, or should I go through the FOS or start a MCOL claim. Any help would be greatly appreciated

Looks like the same standard letter they send to everyone - up to you which route you choose but I reckon you should go with the FO first even tho it will take awhile.0
