Default advice.... Lowells Cap One

Hi

I am totally new to your site....

I have been lurking for some time...and the advice received on a number of issues has been invaluable to date so Thank YOU !!

I have a couple of issues..... I have a default as shown and edited below which seems to be really messing up my credit score and comes from a Cap One card when I was put out of work in 2002....

My questions is ...When will this automatically remove itself from my credit file, becuase Lowells keep up dating the file with random dates. I have had no contact with either party since Cap One state they issued a default notice... With Lowells up dating the file..does this mean I cannot demand the default removed ?????

The card had a limit of £500.00 so I dont know where they get the £823.00 ???

When the d notices are removed are they forgotten for good..!!!!! ????

Your advice would be appreciated

Thanks :j

    That's the important bit.

The default should drop off your Credit Reference Files 6 years from that date. :)

Doesn't matter too much what other stuff Lowells update it with in the meantime really.

    Thank you for your advice..

I note you have underlined Should can a company somehow increase the default notice time ?

If it isnt removed can I demand Experian remove it ? if it isnt removed this July

Is there a legal way about getting Experian to take it off as such ?

    Thanks

Not legally no. You do sometimes get companies record incorrect date though.

If for some reason it does stay on there longer than it should then you can dispute it with Experian and the creditor if it is their fault. Ultimately you can complain to the Information Commissioner if you get no joy from those, who has the legal power under the Data Protection Act to make them take notice.;)

It may well just disappear without problem though. :) But keep an eye on it to see that it does.

    Once again thanks..
  • Hi

Once your default is removed and you have some positive credit...lots of green 0`s ( which I have on a monument card, and a personal loan, car HP) does this mean your average high street lender will lend to you ?

Or do these Defaults and stuff linger somewhere SECRET !

What I mean is .. beside your CRA record do they hold stuff about you from the year dot ????? which they can use against you as such ????

    Thanks,

    FG

There should be no problem however to approach the same bank or credit card would be a different matter......
