Over Paid my coucil tax, but... bit long...

hello,
if you could bear with me and offer a bit of advce that'd be great...
basically i've paid £147 of Ctax on a rented house i don't live in anymore. I've proved this to the council and they agree that I wasn't liable for the C tax...
but because this only came to light after they took the case to court (which i didn't know about because they sent the summons to the adress oi don't live at anymore) they are taking £82 out of my refund to pay the court costs.
i think that this £82 is mine and they should add the costs onto the bill they send to the letting agency as they are the onces who owe the coucil money...
should i write to my council & say this? is there anything i can do to back myself up for them to just say no?
