Please help! 1st Credit refused every payment offer.....

I'm new to this forum but i've been reading the threads and i say well done and thanks to you wonderful guys for the great advice on this forum.
I would like some advice regarding how to deal with 1st Credit who have turned down every payment offer and have threatened to take me to court and put a charge on my property. The debt of £3200 was sold to them from CITICARD. Please could someone please advice what things I can do to deal with this threat. I offered a payment of £10.90 per month after sending them a copy of my income / expenditure statement. Any help would be greatly appreciated:o

    Have you requested a copy of your CCA yet? I would make that my first step.

    Are you in a DMP with anyone?...If not I would recommend you get in touch with one of the free debt help companies ie., CCCS, NATIONAL DEBT HELPLINE, CAB.,.....I'm sure someone will be on who can give you phone numbers..your local CAB should be in your telephone directory.

    This is my story with 1st Credit....I entered into a DMP plan with Payplan [ another good free company you could try ] in February this year, Citi cards sold my debt with them ..£6000 to 1st Credit..My first phone call from 1st Credit ended with me and the man from 1st Credit having a disagreement...basiclly because...even though I am in debt...which I obviously know and am trying to sort....I will not be spoken to like a piece of
    s**t......have had numerous phonecalls from them always refusing to accept my payment offer and asking if I can borrow the money to make a one off payment [ no I can't ]...my last letter from them was a FINAL WARNING telling me that as we could not come to a mutually acceptable agreement they would pass this to a doorstep debt collector who would call and prepare a pre-legal report then report back to them.
    I wrote to them...sending letter recorded delivery...stating that I was not in a position to increase my payment offer and they had a copy of my income and expenditure forms along with my creditor forms from Payplan, that if they would not accept my offer then I would have to look at an IVA or bankruptcy as an alternative route and that I did realise the seriousness of the matter as they could see I had taken strides to get my debts sorted and repaid in full.

    Well heard nothing from them until today....got a phonecall..asked if I was in a position to make a lump payment or increase offer said no....Then they decided they'd accept the offer and review it in 6 months????......very relieved me!!

    Aptly, they aim to collect debts with in 84mths....hence the reason they are so aggressive in their approach......I do not own my own property so have no equity or assests that they could put a charging order on, there are quite a few posts on here and the ''DMP mutual support thread'' by people who have had experiences of dealing with 1st Credit...I'm sure if you take a look you will find someone who can help you better than I can.
    I'm sure there's something somewhere about things being different in the eyes of legal action if debt is below £5000 [ but don't quote me on that ].

    You can't pay more than you can afford and do not let them bully you into committing to a payment that you will not be able to sustain.

    I hope you get things sorted with them...I've still got a debt with Citi Financial [ loan ] that Citi have not accepted offer of payment on....no doubt that will end up in the hands of 1st Credit too!!

    As has been said send a letter by recorded delivery asking for both a signed CCA and a deed of assignmenmt that the debt has been sold to them, enclose a £1 postal order and do not sign the letter (some less than scrupulous DCAs have been known to forge signatures onto CCAs). Without these things they cannot enforce the debt.
    If they do serve a county court summons on you and they have not provided these documents then use that as your defence, but bear in mind they could actually turn up with them in court.
  • I am negotiating with 1credit for my hubby, he refuses to talk on the phone so I have sent the letter requesting all correspondance to be in writing and have sent every letter by recorded delivery. So far they just keep sending letter asking him to call and I keep replying "no I wont call and offering a token payment" we are just going around in circles.

  • Thank you so much for your advice. I'm really encouraged to fight till i win and refuse to be bullied. I have not requested a cca yet. I will request a signed copy of the CCA and deed of assignment. Thanks. I have been communicating to them over the phone and i even made a first debit card payment of £10.90. I am not in a DMP. I have already sent them a my income/expense statement which i signed oops! I'll keep you updated of the progress. You guys are the best :-)
